HUNDRED FIFT1'-FIVE (155) FEET, IN THE CITY <br />OF NORTH OIMSTED. <br />WI-IEREAS, Alidvale Avenue tvas hereto£ore cledicated for xecording nurposes <br />only in the area specified herein, and <br />WHE-REAS, it has been determined by this Council that said roadway is no <br />longer suitable for nublic use, and <br />WfIEREAS, on the 2nd day of April, 1979, a petition by persons owning <br />lots in the irrmiediate vacinity of Midva.le Avenue was duly presented to Council <br />praying that said street from where it intersec:.ts with Dorothy Drive to approx- <br />imately One Hundred Fifty-Five (155) feet west be vacated and the notice <br />requirements specified in the Ohio Revised Code Section 723.026 have been <br />waived by virtue of consent of the affected parties, and <br />WHEREAS, the Planning Corrmlission on the ?day of ?„_. ? 1979 <br />approved vacating DZidvale Avenue as aforesaid,?ng thatj?t was no longer 5, <br />needed for street purposes, and <br />6Vf-iEREAS, Council, upon hearing, is satisfied that there is good cause <br />for such vacation as prayed for, and that it will not be detrimental to the <br />general interest, and ought to be made. <br />NO?N, Tf-iEREFORE, BE IT ORDAINED BY Tf-E COUNCIL OF THE CITY OF NORTH OIM.STED, <br />COUNTY OF CUYAHOGA. Said axea being more specifically delineated on <br />the vacation plat presently on file in the Office of the City Engineer. Said <br />vacation plat is specifically made a nart hereof by reference as if fully <br />rewritten herein.
