_. . , .. . . __..._ . <br /> <br />'0W <br />.??' <br />STANDARD EASEMENT <br />FOR THE <br />INSTALLATION AND MAINTENANCE OF A WATER MAIN <br />FOR CIRCULATION PURPOSES ONLY <br />IINOW ALL MEN BY THESE PRESENTS: That Woodscape Company, an Ohio Corporation, <br />the Grantor, herein, for valuable consideration received and to be received <br />to its full satisfaction does hereby give, grant, bargain and convey to the <br />City of North Olmsted and to the City of Cleveland, a municipal corporation <br />of the State of Ohio, the Grantees herein, the perpetual right-of-way and <br />easement, for the purpose hereinafter mentioned in the following described <br />premises, to wit:- Situated in the City of North Olmsted, County of Cuyahoga, State of <br />Ohio, and known as being part of the Original Dover Township Lot No. 40, and <br />bounded and described as follows: <br />Beginning at the southwesterly corner of Sublot No. 6 in the Welsh <br />Subdivision as recorded in Volume 190, Page 43 of the Cuyahoga County Map <br />Records, said point being in the easterly line of West 230th Street (50 <br />feet wide); <br />Thence South-350-28'-40"-East a distance of 55.00 feet to a point; <br />Thence South-000-59'-41"-East a distance of 55.00 feet to a point; <br />Thence South-890-00'-19"-West a distance of 40.00 feet to a point; <br />Thence North-000-59'-41"-West a distance of 55.00 feet to a point; <br />Thence North-350-28'-40"-West a distance of 55.44 feet to a point <br />in the southerly line of said Welsh Subdivision; <br />Thence North-890-311-20"-East along the said southerly line of <br />Welsh Subdivision a distance of 40.25 feet to the place of beginning <br />as shown in yellow shade on the Water Easement Map prepared by Valley <br />Consultants in December, 1978, be the same more or less, but subject to <br />all legal highways. <br />, <br />In consideration of the mutual covenants herein contained, the Grantor <br />hereby gives, grants and conveys unto said Grantees, the right and easement <br />to enter upon said premises and to lay, install, repair, and maintain therein <br />a water main and all appurtenances connected therewith that in the opinion of <br />the Grantees, their successors or assigns, may be necessary at any time, also, <br />to turn off the water of any main, or to do any other thing that may be neces- <br />sary or advisable in the judgement of said Grantees, their successors or <br />assigns, in order to maintain or operate said main, pipes and appurtenances <br />in accordance with the ordinances, rules, and regulations for the management <br />and protection of said Grantees now in force or that may hereafter be <br />adopted. Further, whenever maintenance or work of any kind is required <br />hereunder, the Grantees, shall not be responsible for restoration of the <br />property or its environs to its original topographical condition, and should <br />also be held blameless for any damage accruing by reason of water leakage <br />from water mains or appurtenances. <br />-1-
