IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH <br />OLMSTED, COUN'I'Y OF CUYAHOC,A ANI) STATE OF OHIO: <br />SECTION l: That Section 517.06 of the Codified Ordinances of the <br />City of North O-lmsted entitled "Pinball Games" which now reads: <br />"517.06 PINBALL GAl`/IES. <br />(a) No person shall keep, maintain, possess or have under control <br />in any place of business or in any other nlace of public resort, <br />any table game or device comonly lrnown as a"pin game", "pinball <br />game" or "marble game", the operation, use or nlay of which is <br />controlled by placing therein any coin, plate, disc, plug, key <br />or other token, or by the payment of a fee. (Ord. 2499. Passed 6-4-57) <br />(b) VVhoever violates this section is guilty of a misdemeanor of the <br />fourth degree." <br />be the same is hereby amended and as amended sha11 read as follows: <br />517.06 PINBALL GAMES. <br />(a)No nerson shall keep, maintain, possess or have under control <br />in any place of business or in any other place of public resort, <br />where intoxicating beverages are sold for carryout, or served on <br />-premises, any table game or device corrmonly lrnown as a"pin game", <br />">>inball ;:ie" or' "marble garzie", the operat ion, use or play of <br />which is controlled by placing therein any coin, plate, disc, <br />plug, key or other token, or by the payment of a fee. (Ord. <br />Passed <br />(b) In places of business or public resort where intoxicating <br />beverages are not sold or served, "pin games", "pi.nbal_1 ganes", <br />or "ma.r'ole games" may be possessed, kept, and maintained provided <br />that the owner thereof shall obtain a permit from the Safety <br />Director of the City of North Olmsted. Said nermit shall be <br />renewable annually in January of every year. A permit fee of <br />Fifty Dollars ($50.00) shall be naid to the City of North Olmsted. <br />Upon the payment thereof the Safety Director shall issue a permit. <br />Nothing contained herein shall be construed so as to:allotir a <br />permit holder to cause or permit to be caused said machines to <br />be used for gambling purposes. Any permit holder convicted of <br />permitting gambling on the premises where said machines are <br />located shall forfeit his permit and shall not be eligible to <br />reapply for a period of five (5) years. <br />(c) Whoever violates this section is guilty of a misdemeanor of <br />the fourth degree. <br />SECTION 2: That Section 517.06 as previously adopted, is hereby <br />repealec.- <br />r <br />SECTION 3: That this Ordinance shall take effect and be in force from <br />and after t e earliest period allowed by law.
