M <br />. ... .?.- 4 i ...:. . ...... . . .. . . <br />A G R E E M E N T <br />? <br />? <br />Between the Board of County Commisioners of <br />Cuyahoga County and the City of North Olmsted for the <br />Repair and Resurfacing of Dover Center Road (CR-58) <br />from Butternut Ridge Road to the <br />North Olmsted North Corporation Line <br />This agreement entered into at Cleveland, Ohio this day of <br />, 1979, by and between the County of Cuyahoga, Ohio, by its <br />Board of County Cormissioners, Party of the First Part and hereinafter <br />referred to as the COUNTY and the City of North Olmsted by its Mayor, having <br />been duly authorized to enter into said agreement by Ordinance No. <br />adopted by Council of the City of North Olmsted on the day of <br />, 1979, Party of the Second Part and hereinafter referred to as <br />the hfUNICIPALITY. <br />WITNESSETH: <br />WHEREAS, the COUNTY and the MUNICIPALITY have mutually agreed by and <br />between themselves to repair and resurface Dover Center Road from Butternut <br />Ridge Road to the North Olmsted North Corporation Line in the City of North <br />Olmsted, all in accordance with plans, specifications and estimates approved <br />by the Cuyahoga County Engineer. <br />WHEREAS, this road project within the corporation limits of the <br />MUNICIPALITY is part of a larger COUNTY project which is the repair and <br />resurfacing of Dover Center Road from Butternut Ridge Road to Center Ridge <br />Road in the City of Westlake and the City of North Olmsted. <br />WHEREAS, the Board of County Commissioners, as administrator of the <br />County Motor Vehicle $5.00 License Tax Fund may, upon approval of an <br />application from the MUNICIPALITY requesting such funds, authorize an <br />allocation of the aforesaid funds to the MUNICIPALITY to pay a portion of the <br />MUNICIPALITY's share of cooperating with the COUNTY in the resurfacing <br />project. <br />NOW THEREFORE, in consideration of <br />contained to be performed by the parties <br />between the parties hereto as follows: <br />the covenants and agreements herein <br />hereto, it is mutually agreed <br />A. SCOPE OF WORK <br />1. That the COUNTY and the MUNICIPALITY will cooperate in <br />the repair and resurfacing of Dover Center Road from <br />Butternut Ridge Road to the North Olmsted North <br />Corporation Line in the City of North Olmsted. <br />B. PLANNING AND PRE-CONSTRUCTION OBLIGATIONS <br />1. That the MUNICIPALITY will prepare resurfacing plans and <br />specifications for the improvement under current Cuyahoga <br />County Engineer standards for construction of County <br />roads. <br />2. That the COUNTY will arrange for the review and approval <br />of the plans and specifications. <br />3. That the COUNTY will arrange for the award of the <br />construction contract. <br />4. That any traffic signalization upgrading, relocation of <br />publically-owned utilities or waterline work made <br />necessary by the improvement will be included in the <br />project but that the MUNICIPALITY will cause to be made, <br />at no expense to the COUNTY, all changes, alterations or <br />repairs to all private or public utilities which are not <br />made necessary by the improvement. <br />- 1 -
