? <br />?- <br />BY : 2n, 2"-a? <br />CITY OF NORTH OD4STED <br />ORDINANCE N0. 79-15 <br />AN ORDINANCE PROVIDING FOR THE SUBMISSION TO THE ELECTORS OF <br />THE CITY OF NORTH OLMSTED OF A PROPOSED AMENDMENT TO THE CHARTER <br />OF THE CITY OF NORTH OLMLSTED RELATING TO PUBLIC BIDDING, AND <br />DECLARING AN IlMERGENCY. <br />WfIEREAS, pursuant to the Charter of the City and the Constitution of the <br />State of Ohio, this Council has determined to authorize and direct the submission <br />to the electors of the City of North Olmsted af the proposed Charter Amendment <br />hereinafter set forth, at the PrimarV Election to be held on Tuesday, June 5, 1979, <br />which election is not less than sixty (60) nor more than One Hundred Twenty (120) <br />days from the date of passage of this Ordinance. <br />NOW, TfEREFORE, BE IT ORDAINED BY THE COiJNCIL OF THE CITY OF NORTH OIMSTED, <br />CUYAHOGA COUNTY, OHIO, TtNO-THIRDS OF ALL MEAlBERS CONCURRING: <br />SECTION 1: That this Council hereby authorizes and directs the submission <br />to the electors of the City of North Olmsted at the Primary Election to be held <br />at the usual places of voting in said City on Tuesday, June 5, 1979, the following <br />proposal to amend the Charter of the City of North Olmsted: <br />PROPOSAL: That Section 6 of Article VIII of the Charter be amended to <br />establish the amount authorized to be expended without public bidding as that <br />provided for by General Law established by the General Assembly of the State of <br />Ohio, such amended Section 6 of Article VIII to read as follows: <br />"ARTICLE VIII <br />SECTION 6: Public Bidding <br />The Council may authorize expenditure of fLmds of the City in <br />amounts exceeding those provided for from time to time by the <br />general laws of the State of Ohio governing municipal corpora- <br />tions without public bidding for the acauisition of real estate, <br />for the discharge of non-contractural claims against the City, <br />for personal services, for the joint use of facilities or <br />exercise of powers with other political subdivisons, or for <br />the product or services of public utilities (including those <br />municipally operated), but no other expenditure of more than <br />that provided for from time to time by the general laws of the <br />State of Ohio governing municipal corporations shall be made <br />except pursuant to contract made with the lowest and best <br />bidder after public advertising and receipt of bids in the <br />manner provided by ordinance." <br />SECTION 2: That if such amendment <br />voting t ereon at such election, it shall <br />time of its approval by the electors. <br />is approved by a majority of the electors <br />become effective from and after the <br />SECTION 3: That the Clerk of Council is hereby authorized and directed to <br />cause a copy o the proposed Charter amendment to be published in such manner <br />as may be authorized by law. <br />SECTION 4: That the Clerk of this Council be and she is hereby authorized <br />and directe to 17orward a certified copy of this Ordinance to the Board of <br />Elections of Cuyahoga County.
