:~ <br />CITY OF NORTH OLMSTED <br />RESOLUTION N0, ` - <br /> <br />BY <br />,~,_ <br />*:, <br /> <br />A RESOLUTION DECLARING THE NECESSITY OF <br />CONSTRUCTING CERTAIN CONCRETE SIDEWALKS <br />AT BRENDAN LANE AND BROOKPARK ROAD <br />EXTENSION, PROVIDING THAT ABUTTING <br />PROPERTY OWNERS CONSTRUCT THE SAME, AND <br />DECLARING AN EMERGENCY. <br />BE IT RESOLVED by the Council of the City of North Olmsted, <br />Cuyahoga County, Ohio: <br />Section 1. That it is necessary to construct concrete side- <br />walks in accordance with the plans, specifications and estimate of cost <br />prepared by the City Engineer and now on file in its office of the Clerk <br />of Council in front of the following properties in the City of North <br />Olmsted: <br />Location Property <br />443b Brendan Lane Permanent Parcel No. 237-22-44 <br />Brookpark Road Extension Permanent Parcel Nos. 232-25-7, <br />(southerly side east of 232-25-34, 232-26-7 and 232-26-12 <br />Dover Center Road) <br />Section 2. That the owners of the lots and lands described <br />in Section 1 of this resolution shall construct, in accordance with the <br />plans and specifications now on file, the sidewalks so described which <br />abut on their respective properties by June 1, 1977; and, if such con- <br />e struction shall not be completed by such date, the City of North Olmsted <br />will construct said sidewalks and the entire cost thereof shall be assessed <br />upon the property of each defaulting owner and made a lien thereon, to be <br />collected in five annual installments as provided by law. <br />Section 3. That the Clerk of this Council is directed to <br />cause a written notice of the adoption of this resolution to be served <br />on each affected property owner as required by law. <br />Section 4. That the plans, specificattons, and estimates of <br />cost far said sidewalk construction, as heretofore filed, are hereby <br />approved. <br />Section 5. That this resolution is hereby delcared to be an <br />emergency measure necessary for the immediate preservation of the public <br />peace, health and safety by virtue of the need for the immediate construc- <br />tion of such sidewalks to permit safe passage by persons using said streets <br />and to eliminate existing hazards to pedestrians; wherefore, this resolution <br />shall be in full force and effect from and immediately after its passage and <br />approval by the Mayor. <br />PASSED /~ ~ <br />ATT ST U <br />i i <br />Nora T.
