<br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 76 - /~'O <br />BY . ~/,~.r/,~i~t-.~uc,c,.,... <br />AN ORDINANCE AUTHORIZING THE BUILDING COD4MISSIONER <br />TO PROCEED WITH THE DEMOLITION OR REMOVAL OF A <br />DETACHED GARAGE LOCATED ON PERA4ANENT PARCEL N0. <br />232-18-32, ON PORTER ROAD, IN THE CITY OF NORTH <br />OLD~STED, AND DECLARING AN EMERGENCY <br />WHEREAS, pursuant to the provisions of Ordinance No. 1331.01 <br />to 1332.99 of the Codified Ordinances of the City of North Olmsted, <br />the Building Commissioner has determined that the detached garage <br />located on Permanent Parcel No. 232-18-32 and further known as <br />4652 Porter Road in the City of North Olmsted the record title <br />holder being R. R. Picar, is unsafe, dangerous to human life and a <br />hazard to the safety, health and public welfare of the citizens <br />of North Olmsted, and <br />WHEREAS, notice to repair, remove and demolish said building <br />was served by certified mail on said record title holder on May 14, <br />1976, ordering said title holder to repair, remove or demolish said <br />detached garage and to commence such repair, removal or demolition <br />within forty-eight hours of receipt of said notice, and <br />WHEREAS, said notice informed the record title holder of his <br />right to appeal condemnation order of the Building Commissioner <br />within fifteen days, and <br />WHEREAS, said record title holder, R. R. Picar, has failed <br />to file an appeal within fifteen days as provided by Section 1131.05 <br />of the Codified Ordinances. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That this Council deems it necessary to proceed <br />with the emolition and removal of the detached garage at 4652 Porter <br />Road, North Olmsted, Ohio, also known as Permanent Parcel No. 232-18-32, <br />owned by R. R. Picar, under the emergency authority of Codified Ordinance <br />No. 1331.07, by reason of the fact that said detached garage has been <br />determined to be dangerous to human life and a hazard to the public <br />safety, health and welfare of the citizens of the City of North Olmsted, <br />and that the cost of said demolition and removal be paid from the <br />General Fund of the City of North Olmsted and charged to the owner as <br />a special assessment or lien on said parcel of land, and assessed <br />and collected in the manner of other assessments as provided by law. <br />SECTION Z: That upon the completion of the demolition and <br />removals ector of Finance is directed to immediately pay for <br />the services rendered to the contractor employed by the City. <br />SECTION 3: That this ordinance is hereby declared to be an <br />emergency measure immediately necessary for the preservation of the <br />public health, safety and welfare, and for the further reason that <br /> <br />
