,. <br />CITY OF NORTH OLMSTED <br />%~ / RESOLUTION N0. 1976 - /6` <br />BY : t ./~. ~.xs..wt.~ <br />A RESOLUTION AUTHORIZING THE DIRECTOR <br />OF LAW TO APPROVE A JOURNAL ENTRY TO ENABLE <br />THE "INTERIM" DISTRIBUTION OF LOCAL <br />GOVERNMENT FUNDS, AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, certain litigation pending in the Supreme Court of <br />Ohio has the effect of preventing distribution of additional <br />unanticipated funds in the 1975 Cuyahoga County Local Government <br />Fund; and other pending litigation has the effect of preventing <br />distribution of the 1976 Local Government Funds; and <br />WHEREAS, it is necessary that we have as much of these funds <br />as is possible in order to meet the financial needs of our <br />municipality, and <br />WHEREAS, the Supreme Court of Ohio has indicated that if all <br />or substantially all governmental units agree to a Journal Entry in <br />the form attached, a distribution shall be made in accordance <br />therewith, and <br />WHEREAS, this resolution constitutes an emergency measure for <br />the immediate preservation of the public welfare and for the usual <br />daily operation of a municipal government, <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION l: That the Director of Law be and he is hereby <br />authoriz- ec~ approve and to execute on behalf of the City a Journal <br />Entry, in the form set forth in Exhibit 1 attached hereto, authorizing <br />an interim distribution of local government funds. <br />SECTION 2: That the Clerk of Council be and she is hereby <br />authorize anddirected to transmit a certified copy of this resolution <br />together with the signed Journal Entry to Mayor Alan Mills of the <br />Cuyahoga County Mayor's Association, in care of Arthur P. Lambros, <br />Attorney at Law, 21270 Lorain Avenue, Fairview Park, Ohio 44126. <br />SECTION 3: That this resolution is hereby declared to be an <br />emergency measure, immediately necessary for the preservation of the <br />public peace, health and safety, and for the further reason that it is <br />necessary to provide the usual funds for the daily operation of the <br />City of North Olmsted, and further provided it receives the affirmative <br />vote of two-thirds of all members elected to Council, it shall take <br />effect and be in force immediately upon its passage and approval by <br />the Mayor. <br />PASSED: ~%~'r'* ~ ~ ~tz~ <br />ATTEST: ~ -~~ {'~ <br />__ <br />a:c.c..~ <br />Nora T.
