-+ CITY OF NORTH OLMSTED ORDINANCE N0. 76 - ~~ AN ORDINANCE ACCEPTING DRAINAGE FACILITIES ON ANTHONY F. AND BEVERLY AND ISABEL E. RUSSO. AN EASEMENT FOR STORM BROXBOURNE ROAD FROM A. RUSSO AND ANTHONY M. WHEREAS, the Engineering Department has determined that a drainage problem exists in and around Permanent Parcel No. 233-19-8 located on Broxbourne Road in the City of North Olmsted, and; WHEREAS, it is the desire of the City of North Olmsted and Anthony F. and Beverly A. Russo and Anthony M, and Isabel E. Russo, the owners of Permanent Parcel No. 233-19-8, to have the City's rights in said storm drains clearly specifidd and made a matter of record by recording a formal easement, and; WHEREAS, this Council deems it in the best interest of the City to accept said easement; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: SECTION l: That this Council does hereby accept an easement from t ony F. and Beverly A. Russo and Anthony M. and Isabel E. Russo for the maintenance, construction, and operation of_ a storm drain over and on the property described herein, and more fully described in the copy of the easement attached hereto, marked Exhibit "A" and made a part hereof as though fully rewritten herein. SECTION 2: That the Finance Department is directed to pay to AntFiony-F-and Beverly A. Russo and Anthony M, and Isabel E. Russo One Dollar ($1.00) which is the consideration for the granting of the easement described herein. SECTION 3: That the Engineering Department of the City of North Olmst^ ecT i~s hereby directed to cause the easement to be recorded in the office of the Cuyahoga County Recorder. SECTION 4: That this Ordinance shall take effect and be in force from an a ter the earliest period allowed by law.
