EASEMENT <br />KNOW ALL MEN BY T~"E PRESENTS, That, The Cleveland Electric Illuminating <br />Coaapany, a. corporation organized and existing under the laxs of the State of Ohio, <br />with its principal office at 55 Public Square Cleveland, Ohio, the Grantor, in <br />consideration of the sum of One Dollar ($1.00 and other valuable considerations <br />received to its full satisfaction of the City of North Olmsted and to the City <br />of Cleveland, municipal corporations of the State of Ohio, the Grantees, does <br />hereby give and grant unto the said Grantees, their successors and assigns, the <br />non-exclusive right and easement to construct, install, maintain, operate, repair, <br />renew and remove an eight (8") inch cement lined ductile iron water line and all <br />necessary appurtenances, at a depth of not less than two and one-half (22') feet <br />below the surface of the ground, in, over and across the following described <br />strip of land twenty (20') feet in width: <br />Situated in the City of North Olmsted, County of Cuyahoga and <br />State of Ohio and known as being part of Original Olmsted Township <br />Lot No. 9, bounded and described as follows: <br />Beginning at the Northerly most corner of Sublot No. 122 in the <br />City Line Estates Resubdivision as recorded in Voltmme 216, Pages <br />47 and 48 of Cuyahoga County flap Records; Thence South 65° 22' 47" <br />Fast along the Northeasterly line of said Sublot No. 122 a distance <br />of 10.11 feet to a point; Thence North 53° 52' ~" East a distance <br />of 274.45 feet to the Southwesterly corner of Sublot Na. 111C in <br />the Bretton Ridge Subdivision No. A as recorded in Volume 195, <br />Pages 52, 53, and 54 of the Cuyahoga County Map Records; Thence <br />65° 48' 02" West along the Northwesterly projection of the South- <br />wester],y line of said Sublot No. 111C, said line also being the <br />Southwesterly line of a parcel of land conveyed to Maxie P. Benuska <br />by deed as recorded in Volume 8895, Page 165 of Cuyahoga County <br />Records, a distance of 23.02 feet to a point; Thence south 53° 52' <br />06" West a distance of 266.71 feet to a point; Thence South 330 <br />08' 31" West a distance of 6.66 feet to the Northeasterly line of <br />Sublot No. 123 in the aforesaid City Line Estates Resubdivision; <br />Thence South 650 22' 47" East along the Northeasterly line of said <br />Sublot No. 123, a distance of 10.11 feet to the place of beginning <br />be the same mor^ or less but subject to all legal highways. <br />TO HAVE AND Ta I~LD said right and easement hereby granted unto the said <br />Grantees, their successors and assigns forever, subject to the conditions set <br />forth below. <br />By the acceptance and delivery of this easement, evidenced by the recorda- <br />Lion thereof, the Grantees specificaLty agree: <br />1. The twenty (20') foot strip of land above described is located <br />within electric transmission line right of way of Grantor and <br />said lines are energized and in service and a high degree of <br />caution is to be observed at all times within said right of way <br />by Grantees, their employees, agents, contractors or licensees <br />and this easement is granted and is sub3ect to the prior rights <br />of Grantor fbr its electric lines thereon and thereover. <br />Grantees agree that said water line will be constructed and <br />maintained in such manner so as not to interfere with Grantor's <br />electric lines or Grantor's longitudinal access along its right <br />of way and over said water line. Grantor agrees that ~dhen <br />Grantees' water line is constructed that thereafter it will <br />place no structure over or so near thereto as will interfere <br />with said water line, nor will Grantor change the grade of its <br />premises so as to interfere therewith. <br /> <br />
