CITY OF NORTH OLMSTED <br />ORDINANCE N0. 76 -~~t,~ <br />AN ORDINANCE ESTABLISHING PROCEDURE <br />FOR THE DISPOSITION OF PROPERTY IN <br />THE CUSTODY OF THE POLICE DEPARTMENT <br />WHICH HAS BEEN LOST, ABANDONED, MIS- <br />PLACED, STOLEN, LAWFULLY SEIZED, OR <br />FORFEITED. <br />WHEREAS, This Council and the Administration desire <br />to establish policy for the City of North Olmsted as it relates <br />to the disposition of property in the custody of the Police <br />Department which has been lost, abandoned, misplaced, stolen, <br />lawfully seized or forfeited; and <br />WHEREAS, Although the Ohio Revised Code does provide <br />a method for the disposal of_ property of the aforesaid nature, it is <br />also permissible under the Ohio Revised Code for local municipalities <br />to establish their own methods and procedures for the disposal of <br />such property. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: DISPOSITION OF PROPERTY HELD BY POLICE. <br />~-P=roperty which has been lost, abandoned, stolen, <br />misplaced, lawfully seized or forfeited and is in the custody of the <br />Police Department shall be deposited and kept in a location designated <br />by the Chief of Police. A record of all such property shall be main- <br />tained, which will include the name of the owner, i_f known, .the person <br />from whom received, the location where found with general circumstances. <br />All property which is evidence shall be kept until it is no longer <br />needed and then disposed of pursuant to this section. <br />(B) The police department shall make a reasonable effort <br />to notify the person entitled to possession of propety in its custody <br />and indicate where such property may be claimed. <br />(C) A person loses any right he may have to title or <br />possession of property. <br />1) which was the subject, or was used in a conspiracy <br />or attempt to commit, or the commission of an offense other <br />than a traffic offense, and such person is a conspirator, <br />accomplice, or of_f_ender with respect to the offense. <br />2) when in light o_f the nature of the property or <br />the circumstances of such person, it is unlawful for him <br />to acquire or possess it. <br />(D) Property unclaimed for ninety (90) days and forfeited <br />property in the custody of the Police Department. shall be disposed of <br />on application to and order of the Mayor as follows: <br />1) Drugs shall be destroyed, or placed in custody of <br />the Secretary of the Treasury of the United States, for <br />disposal or use for medical or scientific purposes under <br />applicable Federal Law. <br /> <br />
