Whenever the number of dwelling <br />units in .multifamily dwellings exceeds twenty percent (20Y) of the total <br />of all dwelling uni:tts in the municipality, any rezoning or zoning for multi- <br />dwelling use, by whatever name classified, approved by the Planning Commission, <br />must be submitted to Council for its consideration. If the Council approves <br />said rezoning or zoning, it shall submit the same to the electorate at the <br />next general election or at a special election within ninety (90) days of <br />Council's approval. If the requested ch~ge is instituted by an applicant, <br />other than the municipality, the applicant may request a special election <br />to be held within ninety (90) days and Council shall so submit the requested <br />change to the electorate, but only after the applicant agrees to assume all <br />costs of the special election including advertising, and further posts a bond <br />with the Director of Finance of the City of North Olmsted. <br />Notice of the election for the requested land use change shall be <br />published in at least two (2) newspapers of general circulation three (3) <br />separate times prior to the election, the first notice shall appear not less <br />than five (5) weeks prior to said election, and the last at least ten (10) <br />days prior to said election. Approval by a majority of the electors voting <br />thereon is mandatory for the zoning or rezoning to pass. <br />YES ~ NO <br />SECTION 3: That the Clerk of this Council is hereby authorized and <br />directed to promptly forward a certified copy of this ordinance to the Board <br />of Elections of Cuyahoga County. <br />SECTION 4: That the Board of Elections of Cu~rahoga County shall <br />cause an appropriate notice to be duly given of the election to be held <br />on November 2, 1976, on the foregoing amendment to the Charter of the City <br />of North Olmsted. <br />SECTION 5: That the Clerk of this Council is hereby authorized and <br />directed to cause notice to be given not less than thirty (30) days prior to <br />November 2, 1976, in accordance with Article 18, Sections 8 and 9 of the <br />Constitution of the State of Ohio or in such other manner as may be provided <br />by general law. <br />SECTION 6: That this ordinance shall become effective immediately <br />upon its passage in accordance with Article 18, Section 8 and 9 of the <br />Constitution of theyS~tate of Ohio. <br />PASSED: Lt-~t, ~ Jn,~ <br />.ATTEST <br />/~, ~ ~ _ <br />NORA T.
