<br />.;~ <br />,%!-<~~ <br />SALVAGE AGREEMENT <br />THIS AGREEMENT made this ~ day of , 1976 <br />by and between the CITY OF NORTH OLMSTED, hereinaf r referred to <br />as "City" , and STEPHEN DOCY of /'sp ~, ~,(~jr ~~ r ~ yr,'w , ~. • <br />hereinafter referred to as "Contractor" : ~~y~~~•~ <br />THE PARTIES AGREE AS FOLLOWS: <br />U:~TDERSTANDING <br />1. The City has heretofore collected from residential <br />dwellings within the City refuse items of a large bulky nature, <br />usually consisting of stoves, refrigerators, water tanks, appliances, <br />and other metals. The parties agree that it is the desire of the <br />City to contract with the Contractor to have him collect said <br />items in return for exclusive salvage rights. <br />TERM <br />2. The term of this Agreement shall be 18 months. The first <br />six months of which shall be considered a trial period. The term <br />of this Agreement shall commence on June 7, 1976. <br />TERMINATION <br />3. This Agreement may be terminated by either of the parties <br />hereto upon the serving of at least 60 days written notice. <br />However, if a breach of contract exists, the City may cancel this <br />Agreement upon three (3) days written notice. <br />ROUTE DESIGNATIONS <br />4. The parties hereto agree that the City shall have the <br />full responsibility/°c~esignating schedules and routes. The Contractor <br />will, according to the schedule, provide pick-up services in the <br />zones designated by the City. The City will furnish to the <br />Contractor a map designating pickup zones. All pick-ups will be <br />made between the hours of 8:00 a.m. and 5:00 p.m. <br />INSURANCE <br />5. It is agreed by and between the parties that the Contractor <br />will carry liability insurance in an amount satisfactory to the <br />Mayor of the City of North Olmsted. Also, the Contractor will <br />name the City of North Olmsted as an additional insured and hereby <br />agrees to hold the-City of North Olmsted harmless from any action <br />or causes of action arising out of the contractor's salvage rights <br />as specified in this Agreement. <br />SAFETY LIGHTS <br />6. All equipment used by the contractor shall be equipped <br />with 4-Way Flashers. The Contractor agrees to have the 4-Way <br />Flashers in use while picking-up refuse items. <br /> <br />
