~a <br />' '`~ ~ _ U i I L I (Y hGt~ E~~;ENT NU. ,3ER 1974 <br />i~~ THE h;ATTER OF 7HE ALTEP.ATION OF <br />P~'3LIC UTILITIES ON INTERSTATE P,OUTE <br />480, SECTION 4.80, IN CUYAHOGA COUNTY, <br />GHIO <br />FcJERAL PROJECT NUM8ER5 I-480-3(3)R/W <br />I-480-4(14)158 CONS <br />AGREEMENT <br />THIS AGREEMENT, made this ~,~ day of 197 <br />Q~ <br />betti~reen the State of Ohio, acting by and through the Director or Trans- <br />portation of the State of Ohio, as First Party, hereinafter referred to <br />as the STATE, and the City of North Olmsted, as Second Party, hereinafter <br />referred to as the CITY, whose office is located in North Olmsted, Ohio. <br />WITNESSETH: <br />WHEREAS, the STATE proposes to construct I-480, and in so doing <br />will cross or affect certain water line and sanitary sewer facilities of <br />the CITY located on property under the jurisdiction of the CITY, and <br />WHEREAS, the CITY is eligible for STATE participation in costs <br />incurred in adjusting CITY utilities located on property under the <br />jurisdiction of the CITY, and <br />4lHEREAS, the CITY has consented to the rearrangement by the STATE <br />of its water line and sanitary sewer facilities as made necessary by <br />construction of this project, and <br />WHEREAS, under such conditions Federal aid funds are eligible to <br />pay a share of such relocation costs. <br />NOW THEREFORE, for and in. consideration of the mutual covenants <br />hereinafter stipulated to be kept and performed, it is agreed between <br />the parties as follows: <br />SECTION 1 - PLANS AND ESTIMATES <br />The STATE shall prepare or cause to be prepared plans and estimates <br />for altering CITY facilities temporarily, if necessary, and permanently <br />to conform to the new highway improvement, and include such work as a <br />bid item in the construction plans. Such plans and estimates shall be <br />prepared in conformance with and as required by Policy and Procedure <br />memorandum 30-4, of the Federal Highway Administration, and any additions, <br />z:nendments or revisions thereto. Plans shall show clearly the existing <br />facilities as weld as the work contemplated in relation to the existing <br />right of way, proposed right of way, and centerline stationing. <br /> <br />
