<br />INSTALLATION AND MAINTENANCE OF A WATER MAIN '
<br />FOR CIRCULATION PURPOSES ONLY
<br />KNOW ALL MEN BY THESE PRESENTS; That I, Marie P'.~ Benuska
<br />
<br />the Grantor, herein, for valuable consideration received and to be
<br />received to my full satisfaction, do hereby give, grant, bargain and
<br />convey to the City of North Olmsted and to the City of Cleveland,
<br />municipal corporations of the State of Ohio, the Grantees herein,
<br />the perpetual right-of-way and easement, for the purpose hereinafter
<br />mentioned in the following described premises, to wit:
<br />Situated in the City of North Olmsted,County of Cuyahoga and
<br />State of Ohio and known as being part of Original Olmsted township
<br />Lot No.9 bounded and described as follows:
<br />Beginning on the Northeasterly line of Westminester Drive (60
<br />feet wide) at its Westerly terminus as shown on the recorded plat of
<br />Bretton Ridge Subdivision No.4A in Volume 195, Pages 52, 53, and 5~,
<br />of Cuyahoga County Map Records; Thence South 1° 16' 23" West-along
<br />the Westerly terminus of l~~estminester Drive and the Westerly line of
<br />Sublot No.111C in_said Bretton Ridge Subdivision No.yA a distance of
<br />214.29 feet to the SoutY~westerly corner of said Sublot No.111C; Thence
<br />North 65° 48' 02" West along the Northwesterly pro3ection of the
<br />Southwesterly line of said Sublot No.111C a distance of 23.02 feet to
<br />a point; Thence__North 53° 52' .06" East a distance of 1.51 feet- to a
<br />point;- Thence North 1°_ 16' 23" East parallel _with-the Westerly- 'line
<br />of said Sublot No.lI1C_ a distance of 242.87 feet -to a Foint; Thence
<br />South 650 48' 02" East a distance of 21.72 feet to the place of be-
<br />ginning be the same more or less-but sub3ect to all legal highways.
<br />.In consideration of the mutual covenants herein contained, the
<br />- Grantor hereby -gives, g-rants and conveys- unto said Grantees, the
<br />• right and easement to enter upon .said premises and to lay, instal 1, -
<br />- repair; and maintain therein a water main and all-appurtenances _
<br />- connected therewith that in the .opinion of the-Grantees, their
<br />successors or assigns,-may be necessary at any time, also, to turn
<br />.off the water of any main, or to do any other thing that may be
<br />necessary or advisable in the judgement of said Grantees, their
<br />successors or assigns, in order to maintain or operate said main,.
<br />. pipes and appurtenances in accordance with-the .ordinances, rules, -
<br />and regulations for the management and protection of said Grantees
<br />now in force or that may hereafter_be adopted, Further, whenever
<br />maintenance or wortc of any kind is required hereunder, the Grantees,
<br />shall not_ be responsible for restoration of the property or its
<br />- environs to its original topographical condition, and should also be
<br />_ field blameless for any damage accruing by reason of water leakage
<br />from water mains or appurtenances. - - -
<br />The Grantee further, i n con si derat ion of the ~rantinq of the
<br />easement above mentioned, by the Grantor does hereby agree to pay
<br />the entire cost of installing a water main and appurtenances within '_
<br />. the above described easement, constructed in accordance with the
<br />- provisions, rules, regulations, and requ i-rements of the s~~ i d Grantee,
<br />their- successors or assigns. Sa i d water main, vat ves, and appurte~n~~nces
<br />- shall upon completion and approva-1 by the Grantees, their successors
