<br />FOR CIRCULATION PURPOSES ONLY
<br />IUNMi ALL MEN BY THESE PRESENTS; That I, Marie P'.• Benuska
<br />the Grantor, herein, for valuable consideration received and to be
<br />received to my full satisfaction, do .hereby give, grant, bargain and
<br />convey to the City of North Olmsted and to the City of Cleveland,
<br />municipal corporations of the State of Ohio, the Grantees herein,
<br />the perpetual right-of-way and easement, for the purpose hereinafter
<br />mentioned in the following described premises, to wit:
<br />Situated in the City of North Olmsted,County of Cuyahoga and
<br />State of Ohio and known as being part of Original Olmsted township
<br />Lot No.9 bounded and described as follows:
<br />Beginning on the Northeasterly line of Westminester Drive (60
<br />feet pride) at its Westerly terminus as shown on the recorded plat of
<br />Bretton Ridge Subdivision No. CIA in Volume 195, Pages 52, 53, and 54,
<br />of Cuyahoga County Map Records; Thence South 1° 16' 23" West along
<br />the Yesterly terminus of ti~7estminester Drive and. the Westerly line of
<br />Sublot No.lI1C in-said. Bretton Ridge Subdivision No. CIA a distance of
<br />244.29 feet `to-the Southwesterly corner-of said Sublot No.111C; Thence

<br />successors or assigns, may be necessary at any time, also, to turn
<br />- _ off the water of any main, or to do any other thing that may be
<br />-necessary or advisable i n the j udyement of said Grantees, the i r
<br />successors or assigns, in order to maintain or operate said main,.
<br />- pipes and appurtenances in accordance with the .ordinances, rules,
<br />and regulations for the management and protection of-said Grantee s
<br />now in force or that may hereafter. be adopted. Further, whenever
<br />maintenance or wortc of any kind i s required hereunder, the Grantees,
<br />shall not be responsib'.e. for restoration of the property or its
<br />~~environs•to its original topographical condition,. and should also be
<br />_ held blameless for any damage accruing by reason of water leakage
<br />from water mains or appu rtenances. ~ -
<br />- The Grantee further, i n c on s i deration of th_e granting of the
<br />easer~nt above mentioned, by the Grantor does hereby agree to pay
<br />the entire cost of installing a water main and appurtenances arithin
<br />. the abcve described easement, constructed in accordance with the
<br />- provisions.; rules, regulations, and requirements of the said Grantee,
<br />their- successors or assigns. Said water main, .valves, and appu rten~~nc
<br />- shall upon•complettion and approva-1 by the Grantees, their~successars
