r <br />CITY OF NORTH OLMSTED <br />.~ <br />ORDINANCE N0. 74 -~~~ <br />ex:~ <br />AN ORDINANCE ESTABLISHING A POLICY FOR <br />THE PAYMENT OF ACCUMULATED SICK LEAVE <br />TIME UPON THE RETIREMENT OF EMPLOYEES <br />OF THE CITY OF NORTH OLMSTED WHO HAVE <br />AT LEAST TEN YEARS SERVICE TIME. <br />WHEREAS, by Ordinance No. 70-58 adopted by the Council of the <br />City of North Olmsted on April 7, 1970, the current sick leave policy <br />was established, and <br />WHEREAS, by virtue of Amended House Bill 1295, the Legislature <br />of the State of Ohio enacted Section 124.391 of the Ohio Revised Code, <br />effective June 29, 1974, clarifying the conversion of sick leave <br />time upon the retirement of governmental employees, and <br />WHEREAS, Ohio Revised Code Sections 124.39 and 124.391 grant <br />authority to municipalities to establish their own policy regarding <br />the conversion of accumulated unused sick leave at the time of <br />retirement, and <br />WHEREAS, it is the desire of both the Administration and the <br />Council to establish a retirement sick leave conversion policy for <br />all City employees with a minimum of ten years service; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That unused sick leave time accumulated in accordance <br />with the provisions of Ordinance No. 70-58 may be converted at the time <br />or retirement for all employees with ten or more years of service. <br />SECTION 2: That the payment for all those who qualify under <br />Section 1 hereof shall be based upon the rate of pay at the time <br />of retirement and payments shall amount to one-fourth of the <br />accumulated sick leave time, but in all instances the maximum amount <br />paid shall not exceed an amount in excess of an accumulation of five <br />(5) days at the employees rate at the time of retirement. <br />SECTION 3: That this ordinance shall take effect and be in force <br />from and after the earliest period allowed by law. <br />PASSED • aZ/ l1?.~ <br />ATTEST <br />~ ~~~ <br />NORA T.
