• ~ v: CITY OF NORTH OLMSTED ORDINANCE NO. 74 -~G~ AN ORDINANCE VACATING 35 FEET OF AN EXISTING 50 FOOT RIGHT-OF-WAY EASEMENT ON ..THREE PARCELS OF LAND LOCATED ON NORTH PARK DAVE, WHICH SAID 35 FEET IS NO LONGER NEEDED FOR STREET PURPOSES. ,WHEREAS, at the time the Froehlich Subdivision was approved by the Planning Commission on May 23, 1972, the Planning Commission requested the developer thereof to reserve the front 50 feet of Parcels 1, 2 and 3 for future roadway purposes, and WHEREAS, this Council is now of the opinion that it-_:.is only necessary to reserve 15 feet of said parcels, each of which carry the following Permanent Parcel Numbers: 232-9-1, 232-9-2 and 232-9-3, and WHEREAS, it is the desire of this Council to keep and maintain 15 feet and vacate 35 feet of the existing easement, and WHEREAS, after referral to the Planning Commission for its recommendation and report pursuant to Section 14 of Article IV of the Charter of the City of North Olmsted, the Planning Commission recommended ayyroval and WHEREAS, this Council is satisfied that there is good cause for vacating the aforesaid portion of the right-of-way which is no longer needed for street purposes; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: SECTION l: That this Council finds that there is cause for the vacation of said 35 feet of the existing 50 foot right-of-way easement, and that such vacation will not be detrimental to the general interest of the City of North Olmsted and ought to be made. SECTION 2: That the City Engineer is hereby instructed to prepare vacation plats respecting the existing easement kept and maintained for street right-of-way purposes which abut and are contiguous to Permanent Parcel Nos. 232-9-1, 232-9-2 and 232-9-3 and the existing North Park Drive, which vacation plat will reflect that the City is vacating 35 feet of the existing 50 foot right-of-way easement and is retaining the balance of 15 feet for street right-of-way purposes and all related uses attendant thereto. SECTION 3: That the Clerk of this Council be and she is hereby instructed to endorse upon the vacation plat the action of this Council in vacating such portion of the street right-of-way and to cause said plat to be recorded in the office of the Recorder of Cuyahoga County.
