• ~ <br /> <br />v: <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 74 -~G~ <br />AN ORDINANCE VACATING 35 FEET OF AN EXISTING <br />50 FOOT RIGHT-OF-WAY EASEMENT ON ..THREE PARCELS <br />OF LAND LOCATED ON NORTH PARK DAVE, WHICH <br />SAID 35 FEET IS NO LONGER NEEDED FOR STREET <br />PURPOSES. <br />,WHEREAS, at the time the Froehlich Subdivision was approved <br />by the Planning Commission on May 23, 1972, the Planning Commission <br />requested the developer thereof to reserve the front 50 feet of <br />Parcels 1, 2 and 3 for future roadway purposes, and <br />WHEREAS, this Council is now of the opinion that it-_:.is only <br />necessary to reserve 15 feet of said parcels, each of which carry <br />the following Permanent Parcel Numbers: 232-9-1, 232-9-2 and 232-9-3, <br />and <br />WHEREAS, it is the desire of this Council to keep and maintain <br />15 feet and vacate 35 feet of the existing easement, and <br />WHEREAS, after referral to the Planning Commission for its <br />recommendation and report pursuant to Section 14 of Article IV of <br />the Charter of the City of North Olmsted, the Planning Commission <br />recommended ayyroval and <br />WHEREAS, this Council is satisfied that there is good cause for <br />vacating the aforesaid portion of the right-of-way which is no longer <br />needed for street purposes; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION l: That this Council finds that there is cause for the <br />vacation of said 35 feet of the existing 50 foot right-of-way easement, <br />and that such vacation will not be detrimental to the general interest <br />of the City of North Olmsted and ought to be made. <br />SECTION 2: That the City Engineer is hereby instructed to prepare <br />vacation plats respecting the existing easement kept and maintained for <br />street right-of-way purposes which abut and are contiguous to <br />Permanent Parcel Nos. 232-9-1, 232-9-2 and 232-9-3 and the existing <br />North Park Drive, which vacation plat will reflect that the City <br />is vacating 35 feet of the existing 50 foot right-of-way easement <br />and is retaining the balance of 15 feet for street right-of-way <br />purposes and all related uses attendant thereto. <br />SECTION 3: That the Clerk of this Council be and she is <br />hereby instructed to endorse upon the vacation plat the action of <br />this Council in vacating such portion of the street right-of-way <br />and to cause said plat to be recorded in the office of the Recorder <br />of Cuyahoga County. <br /> <br />
