.. ,,~ <br />e.: ~,~~ <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 74 - ~~~ <br />AN ORDINANCE AUTHORIZING THE PAYMENT OF <br />$2,103.00 TO BENNETT CONSTRUCTION CO., <br />INC. FOR THE EMERGENCY REPAIR OF A SANITARY <br />SEWER WITHIN THE INTERSECTION OF HUNTER AND <br />DEERFIELD DRIVES, AND DECLARING AN EMERGENCY. <br />WHEREAS, the City crew was in the process of inspecting the <br />sanitary sewer at the intersection of Hunter and Deerfield Drives <br />when a serious break in the sanitary sewer line was discovered, and <br />WHEREAS, it was immediately necessary to take corrective measures <br />to avert a total block of said sewer, and <br />WHEREAS, the Director of Public Service on the basis of an <br />emergency hired the services of Bennett Construction Co., Inc., to <br />repair said sewer; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That this Council does hereby ratify and confirm the <br />action of the Director of Public Service upon the recommendation of <br />the City Engineer in authorizing Bennett Construction Company, Inc. <br />to perform emergency repair work on the sanitary sewer installation <br />at the intersection of Hunter and Deerfield Drives. <br />SECTION 2: That the Director of Finance is hereby authorized <br />to pay Bennett Construction Co., Tnc., the sum of Two Thousand One <br />Hundred and Three Dollars ($2,103.00) for said emergency repair. <br />SECTION 3: That this ordinance is hereby declared to be an <br />emergency measure immediately necessary for the preservation of the <br />public health, safety and welfare, and for the further reason that <br />it is immediately necessary to provide for the immediate payment of <br />the City's just financial obligations, and further provided it <br />receives the affirmative vote of two-thirds of all members elected <br />to Council, it shall take effect and be in force immediately upon <br />its passage and approval by the Mayor. <br />PASSED: ~~ ~ft~,/~ <br />ATTEST: ~ ~ <br />NORA T.
