~.,..,. <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 74 - ~~ <br />BY: ~~~~ <br />AN ORDINANCE REPEALING ORDINANCE NOS. 73-112 <br />AND 73-114 ADOPTED SEPTEMBER 4, 1973, AND <br />ORDINANCE NO. 73-143 ADOPTED DECEMBER 18, 1973. <br />WHEREAS, Resolution No. 74-52 declaring it necessary to construct <br />Brookpark extension was defeated, and <br />WHEREAS, Ordinance Nos. 73-112, 73-114 and 73-143 all deal with <br />the appropriation of property for the construction of Brookpark <br />extension, and <br />WHEREAS, in that the Council has failed to adopt a resolution <br />of necessity to construct said Brookpark extension, the City no <br />longer has a need to appropriate the subject property; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION l: That Ordinance Nos. 73-112 and 73-114 adapted <br />September 4, 1973 and Ordinance No. 73-243 adopted December 18, 1973 <br />are hereby repealed. <br />SECTION 2: That the Law Department is hereby instructed to <br />advise special counsel for the City to withdraw the action for <br />appropriation of the subject property now pending in the probate <br />Court of Cuyahoga County, and that the funds now on deposit be <br />returned to the Director of Finance. <br />SECTION 3: That this ordinance shall take effect and be in <br />fmrce from and after the earliest period allowed by law. <br />PASSED : 2~~-m ~ °? ~ ~,~~ <br />ATTEST: <br />~~~ <br />NORA T.
