<br />CITY OF NORTH OLMSTED <br />RESOLUTION N0. <br />BY <br />A RESOLUTION DECLARING THE NECESSITY OF <br />REPAIRING AND REPLACING CERTAIN CONCRETE <br />SIDEWALKS AT SPECIFIC LOCATIONS WITHIN THE <br />CITY OF NORTH OLMSTED, PROVIDING THAT ABUTTING <br />PROPERTY OWNERS REPAIR AND REPLACE THE SAME, <br />AND DECLARING AN EMERGENCY. <br />BE IT RESOLVED by the Council of the City of North Olmsted, Cuyahoga <br />County, Ohio: <br />Section 1. That it is necessary to repair and replace certain con- <br />crete sidewalks in accordance with the plans, specifications and estimates of <br />cost therefor prepared by the City Engineer and now on file in the offices of <br />the City Engineer and the Clerk of Council. The sidewalks to be repaired and <br />replaced bound and abut upon the properties specifically set forth in Exhibit A <br />attached to this resolution and made a part hereof. <br />Section 2. That the owners of the lots and lands set forth in <br />Exhibit A to this resolution shall repair and replace, in accordance with the <br />plans and specifications now on file, the sidewalks so described which abut on <br />their respective properties within a period of thirty days after the service of <br />notice of the adoption of this resolution; and, if such repair and replacement <br />shall not be completed within such period of thirty days, the City of North <br />Olmsted will repair and replace said sidewalks and the entire cost thereof <br />shall be assessed upon the property of each defaulting owner and made a lien <br />thereon, to be collected in five annual installments as provided by law. <br />Section 3. That the Clerk of this Council is directed to cause a <br />written notice of the adoption of this resolution to be served on each affected <br />property owner as required by law. <br />Section 4. That the plans, specifications, and estimates of cost <br />for said sidewalk construction, as heretofore filed, are hereby approved. <br />Section 5. That this resolution is hereby declared to be an emergency <br />measure necessary for the immediate preservation of the public peace, health <br />and safety by virtue of the need for the immediate construction of such side- <br />walks to permit safe passage by persons using said streets and to eliminate <br />existing hazards to pedestrians; wherefore, this resolution shall be in full <br />force and effect from and immediately after its passage and approval by the <br />Mayor. <br />PASSED ~_, 1974 <br />ATTEST• Francis J.
