~„ <br />.,, <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 74 - ~~~ <br />BY : /'~1'/. . <br />AN ORDINANCE ACCEPTING THREE SEPARATE 15 FT. <br />EASEMENTS TO BE USED FOR POSSIBLE FUTURE <br />ROADWAY IMPROVEMENT ON LAND SITUATED ON <br />NORTH PARK DRIVE IN THE CITY OF NORTH OLMSTED, <br />AND DECLARING AN EMERGENCY. <br />WHEREAS, Davick Builders, Inc. is the owner of three parcels <br />on the southerly side of North Park Drive, namely Permanent Parcel <br />Nos. 232-7-21, 232-7-18 and 232-7-1, and <br />WHEREAS, the City of North Olmsted has obtained easements from <br />other property owners on North Park Drive for possible road right-of- <br />way widening, and <br />WHEREAS, it is the desire of the City of North Olmsted and <br />Davick Builders, Inc. to have the City's rights established in the <br />parcels hereinbefore mentioned, and <br />WHEREAS, this Council deems it in the best interest of the City <br />to accept the easements described herein; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That this Council does hereby accept easements from <br />Davick Builders, Inc. for the purpose of possible future roadway <br />improvement on land situated on North Park Drive in the City of <br />North Olmsted and more fully described in the copy of the easements <br />attached hereto, marked Exhibit "A", and made a part hereof as though <br />fully rewritten herein. <br />SECTION 2: That the Finance Department is directed to pay <br />to Davick Builders, Inc. One Dollar ($1.00) per easement which is <br />the consideration for the granting of the easements described herein. <br />SECTION 3: That the Engineering Department of the City of <br />North Olmsted is hereby directed to cause the easements to be recorded <br />in the office of the Cuyahoga County Recorder. <br />SECTION 4: That this ordinance is hereby declared to be an <br />emergency measure immediately necessary for the preservation of the <br />public health, safety and welfare, and for the further reason that <br />"t is immediately necessary to provide for the orderly development <br />of the City's streets and rights-of-way, and further provided it <br />receives the affirmative vote of two-thirds of all members elected <br />to Council, it shall take effect and be in force immediately upon <br />its passage and approval by the Mayor. <br />PASSED- <br />ATTEST: /~ <br />L~~~ •/ <br />NORA T.
