,~.,. <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 74 - ~~ <br />BY: <br />AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER <br />INTO AN AGREEMENT OF COOPERATION WITH THE <br />BOARD OF GOUNTY COMMISSIONERS OF CUYAHOGA <br />COUNTY FOR THE RESTORATION OF BRIDGE N0. 22 <br />ON CEDAR POINT ROAD, AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, the City of North Olmsted has been informed that <br />Bridge No. 22 on Cedar Point Road is in dire need of repair, and <br />WHEREAS, the County of Cuyahoga through the County Engineer has <br />proposed to restore said bridge with funds derived from the County <br />Motor Vehicle License Tax Fund, and <br />WHEREAS, it is necessary for the City to approve the application <br />for expenditure of funds; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF 'PAE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That it is declared to be in the public interest that <br />the consent of the City of North Olmsted be and such consent is hereby <br />given to the County of Cuyahoga to construct the above described <br />improvement, in accordance with plans, specifications and estimates <br />as approved by the County. <br />SECTION 2: That the City of North Olmsted hereby proposes to <br />cooperate with the County in the cost of the above described improve- <br />ment as follows: <br />A. That the Board of County Commissioners, as administrator of <br />the County Motor Vehicle $5.00 License Tax Fund may upon <br />approval of an application from the City requesting such <br />funds, authorize an allocation of the aforesaid funds to <br />the City to pay the City's share of cooperating with the <br />County in the improvement. <br />B. There shall be no roadway participation other than $5.00 <br />License Tax Funds. <br />SECTION 3; That the Mayor of the City of North Olmsted is hereby <br />authorized to enter into maintenance agreements and special contracual <br />obligations. <br />SECTION 4: That this ordinance is hereby declared to be an <br />emergency measure immediately necessary for the preservation of the <br />public health, safety and welfare, and for the further reason that <br />it is immediately necessary to provide for the repair in order to <br /> <br />
