r ~ <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 74 - ~~ <br />BY : ~~.v~'~22fe6BrC , <br />AN ORDINANCE AUTHORIZING THE BUILDING <br />COMMISSIONER TO PROCEED WITH THE DEMO- <br />LITION OR REMOVAL OF THE DWELLINGS ON <br />PERMANENT PARCEL NO. 235-13-52 ON <br />PORTER ROAD IN THE CITY OF NORTH OLMSTED, <br />AND DECLARING AN EMERGENCY. <br />WHEREAS, pursuant to the provisions of Ordinance No. 1331.01 - <br />1331.99 of the. Codified Ordinances of the City of North Olmsted, the <br />Building Commissioner has determined that the abandoned dwellings <br />known as Permanent Parcel No. 235-13-52 and located at 5723 Porter Rd., <br />North Olmsted, Ohio, the record title holder, Charles E. Reitz, is <br />unsafe, dangerous to human life and a hazard to the safety, health <br />and public welfare of the citizens of North Olmsted, and <br />WHEREAS, notice to repair, remove and demolish said buildings <br />was served by certified mail on said record title holder on May 16 , <br />1974, ordering said title holder to repair, remove or demolish said <br />dwellings and to commence such repair, removal or demolition within <br />forty-eight hours (48) of receipt of said notice, and <br />WHEREAS, said notice informed the record title holder of his <br />right to appeal condemnation order of the Building Commissioner <br />within fifteen (15 ) days , and <br />WHEREAS, said record title holder, Charles E. Reitz, has waived <br />his right to file an appeal within the Fifteen (15) day period, and <br />specifically agrees that the buildings should be demolished and has <br />so indicated his agreement to the demolition as is evidenced by his <br />written agreement attached hereto, marked Exhibit "A" and made a part <br />hereof as though fully rewritten herein; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION l: That this Council deems it necessary to proceed <br />with the demolition and removal of the dwelling and accessory buildings <br />at 5723 Porter Road, North Olmsted, Ohio, also known as Permanent <br />Parcel No. 235-13-52, owned by Charles E. Reitz, under the emergency <br />authority of Codified Ordinance No. 1331.07, by reason of the fact that <br />said dwellings have been determined to be dangerous to human life and <br />a hazard to the public safety, health and welfare of the citizens of <br />the City of North Olmsted, and that the cost of said demolition and <br />removal be paid from the General Fund of the City of North Olmsted <br />and charged to the owner as a special assessment or lien on said <br />parcel of land, and assessed and collected in the manner of other <br />assessments as provided by law. <br />SECTION 2: That upon the completion of the demolition and re- <br />moval, the Director of Finance is directed to immediately pay for the <br />services rendered to the contractor employed by the City. <br />SECTION 3: That this ordinance is hereby declared to be an <br />emergency measure immediately necessary for the preservation of the <br />public health, safety and welfare, and for the further reason that <br /> <br />
