r ~ CITY OF NORTH OLMSTED ORDINANCE NO. 74 - ~~ BY : ~~.v~'~22fe6BrC , AN ORDINANCE AUTHORIZING THE BUILDING COMMISSIONER TO PROCEED WITH THE DEMO- LITION OR REMOVAL OF THE DWELLINGS ON PERMANENT PARCEL NO. 235-13-52 ON PORTER ROAD IN THE CITY OF NORTH OLMSTED, AND DECLARING AN EMERGENCY. WHEREAS, pursuant to the provisions of Ordinance No. 1331.01 - 1331.99 of the. Codified Ordinances of the City of North Olmsted, the Building Commissioner has determined that the abandoned dwellings known as Permanent Parcel No. 235-13-52 and located at 5723 Porter Rd., North Olmsted, Ohio, the record title holder, Charles E. Reitz, is unsafe, dangerous to human life and a hazard to the safety, health and public welfare of the citizens of North Olmsted, and WHEREAS, notice to repair, remove and demolish said buildings was served by certified mail on said record title holder on May 16 , 1974, ordering said title holder to repair, remove or demolish said dwellings and to commence such repair, removal or demolition within forty-eight hours (48) of receipt of said notice, and WHEREAS, said notice informed the record title holder of his right to appeal condemnation order of the Building Commissioner within fifteen (15 ) days , and WHEREAS, said record title holder, Charles E. Reitz, has waived his right to file an appeal within the Fifteen (15) day period, and specifically agrees that the buildings should be demolished and has so indicated his agreement to the demolition as is evidenced by his written agreement attached hereto, marked Exhibit "A" and made a part hereof as though fully rewritten herein; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: SECTION l: That this Council deems it necessary to proceed with the demolition and removal of the dwelling and accessory buildings at 5723 Porter Road, North Olmsted, Ohio, also known as Permanent Parcel No. 235-13-52, owned by Charles E. Reitz, under the emergency authority of Codified Ordinance No. 1331.07, by reason of the fact that said dwellings have been determined to be dangerous to human life and a hazard to the public safety, health and welfare of the citizens of the City of North Olmsted, and that the cost of said demolition and removal be paid from the General Fund of the City of North Olmsted and charged to the owner as a special assessment or lien on said parcel of land, and assessed and collected in the manner of other assessments as provided by law. SECTION 2: That upon the completion of the demolition and re- moval, the Director of Finance is directed to immediately pay for the services rendered to the contractor employed by the City. SECTION 3: That this ordinance is hereby declared to be an emergency measure immediately necessary for the preservation of the public health, safety and welfare, and for the further reason that
