.~ CITY OF NORTH OLMSTED ORDINANCE N0. 74 - 73 a.: h~l-. ~ -,~- AN ORDINANCE AMENDING THE CODIFIED ORDINANCES OF THE CITY OF NORTH OLMSTED BY CREATING A NEW CHAPTER 739 ENTITLED "DISPLAY OF GASOLINE PRICES". WHEREAS, the Council of the City of North Olmsted recognizes that the national energy crisis has drastically affected the price of gaso- line offered for sale at automobile service stations, and WHEREAS, the many automobile service stations in the City sell their products at varying prices, and WHEREAS, the traffic in and about the automobile service stations has become congested due to the inability of prospective customers to determine the price of gasoline offered for sale without first entering the premises, and WHEREAS, this Council believes that the flow of traffic would be enhanced if prices of gasoline were posted in a conspicuous place viewable from the street; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: SECfiION l: That the Codified Ordinances of the City of North Olmste be and are hereby amended by creating a new Chapter 739 en- titled,"Display of Gasoline Prices", which said chapter shall read as fows: CHAPTER 739 D'I'SPLAY OF GASOLINE PRICES 739.0 ~Pc~ting Current Gasoline Prices Every person, firm, co-partnership, association or corporation engaged in the retail sale of gasoline to the general public, shall post on the premises from which such gasoline is sold, the then current selling price per gallon of gasoline offered for sale. In the event gasoline is dispensed or sold at varying prices, the price to be so displayed shall be the lowest price at which gasoline is offered for sale to the motoring public. 739.02 Contents, Size and Placing of Signs (A) Posting of pric s as used in Section 739.01 shall include the Type and grade ~f the gasoline sold or offered for sale at retail, on the premises. Posting within the meaning of Section 739.01 shall be deemed accomplished within the meaning of this chapter, where there is at least one sign and not more than two signs, 22 inches by 28 inches placed above each island of gasoline pumps. Said signs shall be of a permanent nature, constructed from a durable material, either wood, plastic or metal, and shall be clear, visible and legible to motorists traveling the streets and roadways immediately adjacent to the gasoline station. Said signs shall have numerals of a minimum of Ten (10) inches high. (B) The requirements of posting signs specif ied in Section 739.01 hereof shall in no way be .considered to be in violation of the Zoning Ordinances adopted by the City where a gasoline service station has already used the maximum allowable sign area per- mitted by the Zoning Ordinance. ~~ ._._.- w~ .~.. _ . __„~...,~~ a,~,.,.~,a,,..~ ~., I
