.~ <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 74 - 73 <br />a.: h~l-. ~ -,~- <br />AN ORDINANCE AMENDING THE CODIFIED <br />ORDINANCES OF THE CITY OF NORTH OLMSTED <br />BY CREATING A NEW CHAPTER 739 ENTITLED <br />"DISPLAY OF GASOLINE PRICES". <br />WHEREAS, the Council of the City of North Olmsted recognizes that <br />the national energy crisis has drastically affected the price of gaso- <br />line offered for sale at automobile service stations, and <br />WHEREAS, the many automobile service stations in the City sell <br />their products at varying prices, and <br />WHEREAS, the traffic in and about the automobile service stations <br />has become congested due to the inability of prospective customers to <br />determine the price of gasoline offered for sale without first entering <br />the premises, and <br />WHEREAS, this Council believes that the flow of traffic would be <br />enhanced if prices of gasoline were posted in a conspicuous place <br />viewable from the street; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECfiION l: That the Codified Ordinances of the City of North <br />Olmste be and are hereby amended by creating a new Chapter 739 en- <br />titled,"Display of Gasoline Prices", which said chapter shall read <br />as fows: <br />CHAPTER 739 <br />D'I'SPLAY OF GASOLINE PRICES <br />739.0 ~Pc~ting Current Gasoline Prices <br />Every person, firm, co-partnership, association or corporation engaged <br />in the retail sale of gasoline to the general public, shall post on <br />the premises from which such gasoline is sold, the then current selling <br />price per gallon of gasoline offered for sale. In the event gasoline <br />is dispensed or sold at varying prices, the price to be so displayed <br />shall be the lowest price at which gasoline is offered for sale to <br />the motoring public. <br />739.02 Contents, Size and Placing of Signs <br />(A) Posting of pric s as used in Section 739.01 shall include the <br />Type and grade ~f the gasoline sold or offered for sale at <br />retail, on the premises. Posting within the meaning of <br />Section 739.01 shall be deemed accomplished within the meaning <br />of this chapter, where there is at least one sign and not more <br />than two signs, 22 inches by 28 inches placed above each island <br />of gasoline pumps. Said signs shall be of a permanent nature, <br />constructed from a durable material, either wood, plastic or <br />metal, and shall be clear, visible and legible to motorists <br />traveling the streets and roadways immediately adjacent to the <br />gasoline station. Said signs shall have numerals of a minimum <br />of Ten (10) inches high. <br />(B) The requirements of posting signs specif ied in Section 739.01 <br />hereof shall in no way be .considered to be in violation of the <br />Zoning Ordinances adopted by the City where a gasoline service <br />station has already used the maximum allowable sign area per- <br />mitted by the Zoning Ordinance. <br />~~ ._._.- <br />w~ .~.. _ . __„~...,~~ <br />a,~,.,.~,a,,..~ ~., <br />I <br />
