CITY OF NORTH OLMSTED <br />ORDINANCE N0. 74 -.S~c~ <br />BY: <br />AN ORDINANCE ACCEPTING AN EASEMENT FOR <br />AN EXISTING STORM DRAIN SEWER LOCATED <br />ON PRIVATE PROPERTY WHICH ABUTS BROOKPARK <br />ROAD AND IS SITUATED GENERALLY BETWEEN <br />GRACE AVENUE AND GEORGETTE AVENUE IN THE <br />CITY OF NORTH OLMSTED, AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, The Big Four Lumber Company is the owner of property <br />which abuts Brookpark Road and is situated generally between Grace <br />Avenue and Georgette Avenue, and there is now situated on said <br />property a storm sewer which services Georgette Avenue, for which <br />there is no easement of record specifying the City's rights in said <br />facility, and <br />WHEREAS, it is the desire of the City of North Olmsted and The <br />Big Four Lumber Company to have the City's rights in said storm sewer <br />clearly specified and made a matter of record by recording a formal <br />easement, and <br />WHEREAS, this Council deems it in the best interest of the <br />City to accept the easement described herein; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION l: That this Council does hereby accept an easement <br />from the Big Four Lumber Company for the maintenance of a storm <br />drainage sewer over and on the property described herein, and more <br />fully described in the copy of the easement attached hereto, marked <br />Exhibit "A", and made a part hereof as though fully rewritten herein» <br />SECTION 2: That the Finance Department is directed to pay <br />to The Big Four Lumber Company One Dollar ($1.00) which is the <br />consideration for the granting of the easement described herein. <br />SECTION 3: That the Engineering Department of the City of <br />North OLmsted is hereby directed to cause the easement to be recorded <br />in the office of the Cuyahoga County Recorder. <br />SECTION 4: That this ordinance is hereby declared to be an <br />emergency measure immediately necessary for the preservation of the <br />public health, safety and welfare, and for the further reason that <br />the City's rights in and to the existing storm sewer must be protected, <br />and further providing it receives the affirmative vote of two-thirds of <br />all members elected to Council, it shall take effect and be in force <br />immediately upon its passage and approval by the Mayor. <br />Passed: ~~ /G f~~t~ <br />Attest: <br />;,~~~~~ <br />Nora T.
