h, <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 74 - ~~ <br />BY• <br />AN ORDINANCE AUTHORIZING THE BUILDING <br />COMMISSIONER TO PROCEED WITH THE DEMO- <br />LITION OR REMOVAL OF THE D[~ELLINGS ON <br />PERMANENT PARCEL N0. 234-22-35, STEARNS <br />ROAD, NORTH OLMSTED, OHIO. <br />WHEREAS, pursuant to the provisions of Ordinance No. 1331.01 - <br />1331.99 of the Codified Ordinances of the City of North Olmsted, the <br />Building Commissioner has determined that the abandoned dwellings <br />known as Permanent Parcel No. 234-22-35 and located at 6426 Stearns <br />Road, North Olmsted, Ohio, the record title holder, Mr. Glen DeMaison, <br />is unsafe, dangerous to human life and a hazard to the safety, health <br />and public welfare of the citizens of North Olmsted; and <br />WHEREAS, notice to repair, remove and demolish said buildings <br />was served by certified mail on said record title holder on January 16, <br />1974, ordering said title holder to repair, remove or demolish said <br />dwellings and to commence such repair, removal or demolition within <br />forty-eight hours (48) of receipt of said notice, and <br />WHEREAS, said notice informed the record title holder of his <br />right to appeal condemnation order of the Building Commissioner <br />within fifteen days (15), and <br />WHEREAS, said record title holder, Glen DeMaison, did appeal <br />within the time allowed by law, and the Board of Building Code <br />Appeals on February 28, 1974 upheld the Building Commissioner and <br />ordered the demolition of said buildings, which order has not. been <br />carried out and the record title holder has failed to comply; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That Council deems it necessary to proceed with the <br />demolition and removal of the dwellings or accessory buildings at <br />6426 Stearns Road, North Olmsted, Ohio, also known as Permanent <br />Parcel No. 234-22-35, owned by Glen DeMaison, whose mailing address <br />is R.D.#5 Mercer Type Rd., Meadville, Pennsylvania 16335, by reason <br />of the fact that said dwellings have been determined to be dangerous <br />to human life and a hazard to the public safety, health and welfare <br />of the citizens of the City of North Olmsted, and that the cost of <br />said demolition and removal be paid from the General Fund of the City <br />of North Olmsted and charged to the owner as a special assessment or <br />lien on said parcel of land, and assessed and collected in the manner <br />of other assessments as provided by law. <br />SECTION 2: That the Clerk of Council be and she is hereby directed <br />to forward to Mr. Glen DeMaison at R.D.#5 Mercer Type Road, Meadville, <br />Pennsylvania 16335, a copy of this Ordinance. <br />
