h, CITY OF NORTH OLMSTED ORDINANCE NO. 74 - ~~ BY• AN ORDINANCE AUTHORIZING THE BUILDING COMMISSIONER TO PROCEED WITH THE DEMO- LITION OR REMOVAL OF THE D[~ELLINGS ON PERMANENT PARCEL N0. 234-22-35, STEARNS ROAD, NORTH OLMSTED, OHIO. WHEREAS, pursuant to the provisions of Ordinance No. 1331.01 - 1331.99 of the Codified Ordinances of the City of North Olmsted, the Building Commissioner has determined that the abandoned dwellings known as Permanent Parcel No. 234-22-35 and located at 6426 Stearns Road, North Olmsted, Ohio, the record title holder, Mr. Glen DeMaison, is unsafe, dangerous to human life and a hazard to the safety, health and public welfare of the citizens of North Olmsted; and WHEREAS, notice to repair, remove and demolish said buildings was served by certified mail on said record title holder on January 16, 1974, ordering said title holder to repair, remove or demolish said dwellings and to commence such repair, removal or demolition within forty-eight hours (48) of receipt of said notice, and WHEREAS, said notice informed the record title holder of his right to appeal condemnation order of the Building Commissioner within fifteen days (15), and WHEREAS, said record title holder, Glen DeMaison, did appeal within the time allowed by law, and the Board of Building Code Appeals on February 28, 1974 upheld the Building Commissioner and ordered the demolition of said buildings, which order has not. been carried out and the record title holder has failed to comply; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: SECTION 1: That Council deems it necessary to proceed with the demolition and removal of the dwellings or accessory buildings at 6426 Stearns Road, North Olmsted, Ohio, also known as Permanent Parcel No. 234-22-35, owned by Glen DeMaison, whose mailing address is R.D.#5 Mercer Type Rd., Meadville, Pennsylvania 16335, by reason of the fact that said dwellings have been determined to be dangerous to human life and a hazard to the public safety, health and welfare of the citizens of the City of North Olmsted, and that the cost of said demolition and removal be paid from the General Fund of the City of North Olmsted and charged to the owner as a special assessment or lien on said parcel of land, and assessed and collected in the manner of other assessments as provided by law. SECTION 2: That the Clerk of Council be and she is hereby directed to forward to Mr. Glen DeMaison at R.D.#5 Mercer Type Road, Meadville, Pennsylvania 16335, a copy of this Ordinance.
