G~~~ <br />By /~~t/ <br />A RESOLUTION REPEALING RESOLUTION N0. 73-120 <br />AND RESOLUTION N0. 74-24 RELATING TO THE <br />IMPROVEMENT OF THE BROOKPARK ROAD EXTENSION, <br />AND DECLARING AN EMERGENCY. <br />WHEREAS, this Council on September 18, 1973 adopted Resolution <br />No. 73-120 declaring it necessary to improve the Brookpark Road Extension <br />from its present easterly terminus to Lorain Road and on March S, 1974 <br />adopted Resolution No. 74-24 appointing an assessment equalization board <br />to hear objections relative to the estimated assessments for said improve- <br />ment; and <br />WHEREAS, the original estimate of cost for said improvement and the <br />estimated assessments based thereon were insufficient to cover the total <br />cost of the improvement in that the cost of acquiring right-of-way was <br />not included therein and an inadequate amount was included for interest <br />on notes and bonds prior to the first collection of the estimated assess- <br />ments; and <br />WHEREAS, a revised estimate of cost for said improvement has now been <br />prepared which includes the items of cost omitted from the earlier estimate <br />and this Council has determined that new assessment proceedings should be <br />commenced on the basis of the revised estimate of cost; <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of North <br />Olmsted, Cuyahoga County, Ohio: <br />Section 1. That Resolution No. 73-120, adopted September 18, 1973, <br />declaring it necessary to improve the Brookpark Road Extension, and <br />Resolution No. 74-24, adopted March 5, 1974, appointing an assessment <br />equalization board to hear objections to the estimated assessments for <br />said improvement, be and the same are hereby repealed. <br />Section 2. This resolution is hereby declared to be an emergency <br />measure necessary for the immediate preservation of the public peace, <br />health and safety of said City, and for the further reason that the imme- <br />diate construction of said improvement is necessary to eliminate existing <br />hazards to pedestrian and vehicular traffic and the repeal of the aforesaid <br />resolutions is necessary to permit new assessment proceedings to be initiated <br />for said improvement; wherefore, this resolution shall be in full force and <br />effect from and immediately after its adoption and approval by the Mayor. <br />PASSED: ~~ `~~~ <br />ATTEST: G/G~ ~4/ K'~'`-'~''" ~----~ <br />Nora T.
