CITY OF NORTH OLMSTED <br />ORDINANCE N0. 74 -~~ <br />-~ <br />AN ORDINANCE AUTHORIZING THE CONTINUANCE OF <br />EMPLOYMENT OF THOMAS R. SKULINA AS SPECIAL <br />LEGAL COUNSEL IN THE DEFENSE OF THE CITY AND <br />MEMBERS OF COUNCIL IN THE CASE OF SARINGER, <br />ET AL. VS. CITY OF NORTH OLMSTED, ET AL., AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, the City of North Olmsted previously employed the <br />services of Thomas R. Skulina, Attorney at Law, to assist J. Bruce <br />Kitchen who was the Director of Law at the time the case of <br />Saringer, et al. vs. City of North Olmsted, et al., Common Pleas <br />Court Case No. 891,733 was filed, and <br />WHEREAS, this Council recognizes that Michael R. Gareau, the <br />duly elected and presently acting Director of Law of the City of <br />North Olmsted, was at the time of the filing of the aforementioned <br />lawsuit, attorney for the plaintiffs, and <br />WHEREAS, City Council also recognizes that <br />a conflict of interest to have Michael R. Garea• <br />said lawsuit when he had previously represented <br />it is, .therefore, the desire of this Council to <br />Attorney at Law, continue to represent the City <br />said lawsuit; <br />it would constitute <br />a defend the City in <br />.the plaintiffs, and <br />have Thomas R. Skulina, <br />in the defense of <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That Thomas J. Skulina continue to defend the City <br />in the case entitled Saringer, et al. vs. City of North Olmsted, et al., <br />Common Pleas Court Case No. 891,733 in the Court of Common Pleas, <br />Cuyahoga County. <br />SECTION 2: That the said Thomas R. Skulina shall be answerable <br />to the Mayor and that the compensation for his services shall not <br />exceed Forty-five Dollars ($45.00) per hour. In addition, he shall <br />be reimbursed for all expenses expended on behalf of the City in the <br />defense of this case. <br />SECTION 3: That the Director of Finance is authorized to make <br />payments to said Thomas R. Skulina upon receipt of an itemized state- <br />ment approved by the Mayor. <br />SECTION 4: That this ordinance is hereby declared to be an <br />emergency measure immediately necessary for the preservation of the <br />public health, safety and welfare, and for the further reason that <br />it is imperative that the City continue to have legal representation <br />in that the case is presently pending and further Legal action is <br />necessary, and further provided it receives the affirmative vote of <br />two-thirds of all members elected to Council, it shall take effect and <br />be in force immediately upon its passage and approval by the Mayor. <br />PASSED: /.t.~~%f.~Ctte,~ ~.../~~~ <br />ATTEST: v <br />L/~~ ,/~ <br />NORA T.
