CITY OF NORTH OLMSTED <br />ORDINANCE NO. 74 - ~~ <br />/ d <br />BY• <br />AN ORDINANCE 1~,CCEPTING AN EASEMENT FOR <br />THE INSTALLATION AND MAINTENANCE OF A <br />WATER MAIN FOR THE PURPOSE OF SUPPLYING <br />WATER SERVICE BY THE CITY OF CLEVELAND <br />TO PRIVATE PROPERTY WHICH ABUTS BROOKPARK <br />ROAD AND IS SITUATED GENERALLY BETWEEN <br />C3RACE AVENUE AND GEORGETTE AVENUE, AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, The Big Four Lumber Company is the owner of property <br />which abuts Brookpark Road and is situated generaliy between Grace <br />Avenue and Georgette Avenue, and it is its desire to be provided <br />with water service from the City of Cleveland, and <br />WHEREAS, the City of Cleveland requires that extensions of <br />water lines on private property shall be approved only if easements <br />are granted to both the City of Cleveland and the City of North <br />Olmsted so that water mains may be constructed and maintained therein, <br />and <br />WHEREAS, this Council deems it to be in the best interest of <br />the City to accept the easement described herein; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION l: That this Council does hereby accept an easement <br />from The Big Four Lumber Company for the installation and maintenance <br />of a water main for the purpose of supplying water service by the <br />City of Cleveland into the property described herein, a copy of said <br />easement being attached hereto marked Exhibit "A" and made a part <br />hereof as though fully written herein. <br />SECTION 2: That the Engineering Department of the City of <br />North Olmsted is hereby directed to cause the easement to be recorded <br />in the office of the County Recorder. <br />SECTION 3: That the Clerk of this Council is hereby authorized <br />and directed to forward a certified copy of this Ordinance to the <br />Director of Public Utilities of the City of Cleveland. <br />SECTION 4: That this ordinance is hereby declared to be an <br />emergency measure immediately necessary for the preservation of the <br />public health, safety and welfare, and for the further reason it is <br />necessary to accept this easement so that water may be available and <br />
