CITY OF NORTH OLMSTED <br />BY : ~~ <br />ORDINANCE NO. 74 - 9 <br />AN ORDINANCE AMENDING SECTION 333.07 <br />ENTITLED "PEELING TIRES AND NOISY <br />EXHAUST; PENALTY" OF CHAPTER 333 OF <br />THE TRAFFIC CODE OF THE CITY OF NORTH <br />OLMSTED AND ENACTIIIG A NEW SECTION <br />333.99 ENTITLED "PENALTY", AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, Subsection "b" of Section 333.07 is in error, and <br />WHEREAS, it is necessary to establish a penalty section in Chapter <br />333 of the Traffic Code; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, STATE OF OHIO: <br />SECTION 1: That Section 333.07 entitled "Peeling Tires and Noisy <br />Exhaust; Penalty" of Chapter 333 of the Traffic Code of the City of <br />North Olmsted be and the same is hereby amended, and as amended shall <br />read as follows: <br />"333.07 PEELING TIRES AND NOISY EXHAUST <br />No person shall operate any motor vehicle, except when necessary for <br />safe operation or in compliance with law, in such a manner that the <br />vehicle is so rapidly accelerated or started from a stopped position <br />that the exhaust system emits a loud;~cracking or chattering noise <br />unusual to its normal operation, or the tires of such vehicle squeal <br />or leave tire marks on the roadway, commonly called "peeling"." <br />SECTION 2: That there is hereby enacted new Section 333.99 which <br />shall read as follows: <br />"333.99 PENALTY <br />Whoever violates Section 333.01, 333.02, 333.06, shall be guilty of a <br />misdemeanor in the first degree. Any other violations of this section <br />shall be governed by Section 303.99 entitled "Penalties for Misdemeanor" <br />of Chapter 303." <br />SECTION 3: That Section 333.07 as previously adopted, and any <br />other ordinances or parts of ordinances in conflict herewith are hereby <br />repealed. <br />SECTION 4: That this ordinance is hereby declared to be an emer- <br />gency measure immediately necessary for the preservation of the public <br />health, safety and welfare, and for the further reason it is immediately <br />necessary to amend the Traffic Code to comply with the State Code <br />requirements and for the ease of the administration of the enforcement <br />of the traffic ordinances, and further provided it receives the affirma- <br />tive vote of two-thirds of all members of Council, it shall take effect <br />and be in force immediately upon its passage and approval by the Mayor. <br />~ Passed: ~ _1'L <br />Attest: <br />NORA T.
