~- <br />BY: <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 74 - <br />AN ORDINANCE AMENDING SECTION 303.99 <br />ENTITLED "PENALTIES" OF CHAPTER 303; <br />SECTION 351.99 ENTITLED "PENALTIES" <br />OF CHAPTER 351; SECTION 353.99 ENTI- <br />TITLED "PENALTIES" OF CHAPTER 353; <br />SECTION 373.99 ENTITLED "PENALTIES" <br />OF CHAPTER 373; SECTION 375.99 ENTI- <br />TITLED "PENALTIES" OF CHAPTER 375, <br />AND SECTION 377.99 ENTITLED "PENALTIES" <br />OF CHAPTER 377 OF THE TRAFFIC CODE OF <br />THE CODIFIED ORDINANCES OF THE CITY OF <br />NORTH OLM5TED, AND DECLARING AN EP•4ERGENCY. <br />WHEREAS, the General Assembly of the State of Ohio adopted a new <br />criminal code by virtue of the passage of House Bill 511, and <br />T^7HEREAS, the adopted penalties with respect to all misdemeanors <br />affect the penalties now incorporated in Part Three - Traffic Code - <br />of the Codified Ordinances of the City of North Olmsted, and <br />WHEREAS, it is the desire of the Council and the Administration <br />to canform the Traffic Code of the City of North Olmsted to the <br />penalties now adopted under the Penal Cade of the State of Ohio; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, STATE OF ~~HIO <br />SECTION l: That the following sections and sub-sections of <br />Part Three entitled "Traffic Code" of the Codified Ordinances of <br />North Olmsted are hereby amended as indicated: <br />CHAPTER 3'03 <br />303.99 PENALTIES FOR MISDEMEANOR. <br />Unless otherwise specifically provided: <br />(a) Whoever is convicted of or pleads guilty to a misdemeanor, <br />other than a minor misdemeanor, shall be imprisoned for a <br />definite term or fined, or both, which term of imprisonment <br />and fine shall be fig>ed by the court as provided in this <br />section. <br />(b) <br />(c) <br /> <br />Terms of imprisonment for misdemeanor shall be imposed as <br />follows: <br />(1) For a misdemeanor of the first degree, not more than six <br /> months; <br />(2) For a misdemeanor of the second degree, not more than <br /> ninety days; <br />(3) For a misdemeanor of the third degree, not more than <br /> sixty days; <br />(4) For a misdemeanor of the fourth degree, not more than <br /> thirty days. <br />Fines for misdemeanor sha ll be imposed as fo llows: <br />(1) For a misdemeanor of the first degree, not more than <br /> One Thousand Dollars ($1, 000.00); <br />(2) For a misdemeanor of the second degree, not more than <br /> Seven Hundred Fifty Dollars ($750.00); <br />
