~- BY: CITY OF NORTH OLMSTED ORDINANCE NO. 74 - AN ORDINANCE AMENDING SECTION 303.99 ENTITLED "PENALTIES" OF CHAPTER 303; SECTION 351.99 ENTITLED "PENALTIES" OF CHAPTER 351; SECTION 353.99 ENTI- TITLED "PENALTIES" OF CHAPTER 353; SECTION 373.99 ENTITLED "PENALTIES" OF CHAPTER 373; SECTION 375.99 ENTI- TITLED "PENALTIES" OF CHAPTER 375, AND SECTION 377.99 ENTITLED "PENALTIES" OF CHAPTER 377 OF THE TRAFFIC CODE OF THE CODIFIED ORDINANCES OF THE CITY OF NORTH OLM5TED, AND DECLARING AN EP•4ERGENCY. WHEREAS, the General Assembly of the State of Ohio adopted a new criminal code by virtue of the passage of House Bill 511, and T^7HEREAS, the adopted penalties with respect to all misdemeanors affect the penalties now incorporated in Part Three - Traffic Code - of the Codified Ordinances of the City of North Olmsted, and WHEREAS, it is the desire of the Council and the Administration to canform the Traffic Code of the City of North Olmsted to the penalties now adopted under the Penal Cade of the State of Ohio; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, STATE OF ~~HIO SECTION l: That the following sections and sub-sections of Part Three entitled "Traffic Code" of the Codified Ordinances of North Olmsted are hereby amended as indicated: CHAPTER 3'03 303.99 PENALTIES FOR MISDEMEANOR. Unless otherwise specifically provided: (a) Whoever is convicted of or pleads guilty to a misdemeanor, other than a minor misdemeanor, shall be imprisoned for a definite term or fined, or both, which term of imprisonment and fine shall be fig>ed by the court as provided in this section. (b) (c) Terms of imprisonment for misdemeanor shall be imposed as follows: (1) For a misdemeanor of the first degree, not more than six months; (2) For a misdemeanor of the second degree, not more than ninety days; (3) For a misdemeanor of the third degree, not more than sixty days; (4) For a misdemeanor of the fourth degree, not more than thirty days. Fines for misdemeanor sha ll be imposed as fo llows: (1) For a misdemeanor of the first degree, not more than One Thousand Dollars ($1, 000.00); (2) For a misdemeanor of the second degree, not more than Seven Hundred Fifty Dollars ($750.00);
