J~" R e BY: CITY OF NORTH OLMSTED ORDINANCE N0. 75 - .~~ AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO A COOPERATION AGREEMENT WITH THE CUYAHOGA COUNTY BOARD OF COMMISSIONERS FOR THE UTILIZATION OF FUNDS MADE AVAILABLE BY THE HOUSING AND COMMUNITY DEVELOPMENT ACT OF 1974, AND DECLARING AN EMERGENCY ., AS AMENDED . WHEREAS, the Housing and Community Development Act of 1974 provides an entitlement of funds for community development purposes for urban counties, and WHEREAS, Cuyahoga County may be designated as an Urban County provided that it secures Cooperation Agreements with various municipalities in Cuyahoga County, and WHEREAS, the Mayor and the Council of the City of North Olmsted encourage the use of "Urban County Entitlement Funds" for needed public improvements in Cuyahoga County and its municipalities, and WHEREAS, the County has applied for and received a grant for such Urban County Entitlement Funds pursuant to Title I of the Housing and Community Development Act of 1974 for the period July 18, 1975 through July 17, 1976, and WHEREAS, the County shall prepare an application for such Urban County Entitlement Funds pursuant to the aforementioned Act for the period July 18, 1976 through July 17, 1977, and WHEREAS, no less than forty percent (40~) of the total "Urban County Entitlement Funds" for Cuyahoga County will be expended by the Cuyahoga County Board of Commissioners on behalf of the participating municipalities to finance eligible community development activities, programs, and projects in said participating municipalities, and WHEREAS, the distribution of the funds made available through the above policy shall be allocated and expended on behalf of each participating municipality as closely as possible according to the population of each participating municipality for plans, programs, and projects eligible under the provisions of the Housing and Community Development Act of 1974, and WHEREAS, the Mayor of the City of North Olmsted may appoint one (1) member to a Policy Committee whose duty it shall be to assist the Cuyahoga County Board of Commissioners in the review of all applications, plans, programs, and projects for which "Urban County Entitlement Funds" may be used; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: SECTION l: That the Mayor is hereby authorized and directed to enter into a Cooperation Agreement with the Cuyahoga County Board of Commissioners for the period commencing January 1, 1976, through July 17, 1978, authorizing said Board of County Commissioners to execute applications, plans, programs, and projects eligible under the Housing and Community Development Act of 1974 on behalf of the City of North Olmsted, provided, however, that the City can rescind said authorization on or after July 17, 1977. A copy of said Cooperation Agreement is attached hereto, marked Exhibit "A", and made a part hereof as though fully rewritten herein.
