,~ <br />.CITY OF NORTH OLMSTED <br />ORDINANCE N0. 75-211 <br />BY: <br />AN ORDINANCE AUTHORIZING THE DIRECTOR OF LAW <br />TO APPROVE A JOURNAL ENTRY TO ENABLE THE <br />"INTERIM" DISTRIBUTION OF LOCAL GOVERNMENT <br />FUNDS, AND DECLARING AN EMERGENCY. <br />WHEREAS, certain litigation pending in the Supreme Court of Ohio <br />has the effect of preventing distribution of the 1975 Local Government funds; <br />and <br />WHEREAS, it is necessary that we have as much of these funds as is <br />possible in order to meet the financial needs of our municipality; and <br />WHEREAS, the Supreme Court of Ohio has indicated that if all or <br />substantially all governmental units agree to a Journal Entry in the form <br />attached, a distribution of approximately one hundred percent (100%) of an <br />amount equal to the "lower" of either the County Budget Commission (as <br />affirmed by the Board of Tax Appeals) or the allocation as proposed by the <br />City of Cleveland in its appeal to the Board of Tax Appeals; and <br />WHEREAS, the proposed Journal Entry has provisions for repayment in the <br />event the advance to any subdivision is greater than the final determination of <br />the Court; ,T~ ~: <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, <br />COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That the Director of Law he and he is hereby authorized to <br />approve and to execute on behalf of the City a Journal Entry, in the form set <br />forth in Exhibit I attached hereto, authorizing an interim distribution of local <br />government funds. <br />SECTION 2: That the Clerk of Council be and is hereby authorized and <br />directed to transmit a certified copy of this ordinance together with the signed <br />Journal Entry to the Budget Commission of Cuyahoga County, Room 301, County <br />Administration Building, 1219 Ontario Street, Cleveland, Ohio, 44113, for inclu- <br />sion in a master Journal Entry to be presented to the Supreme Court of Ohio. <br />SECTION 3: That this ordinance is hereby declared to be an emergency <br />measure, immediately necessary for the preservation of the public peace, health, <br />and safety of the City, and for the further reason that thc~is necessary to provide <br />the usual funds for the daily operation of the City of North Olmsted, and further <br />provided it receives the affirmative vote of two-thirds of all members elected to <br />Council, it shall take effect and be in force immediately upon its passage and <br />approval by the Mayor. <br />PASSED: ~ l~t~C_ ~4, ~~,J~ <br />ATTES <br />/ V ft:c.~G.~ <br />/%~,a"~,,~,f <br />NORA T.
