The Commission shall have the authority to establish, <br />within the spirit and purposes of this Chapter, criteria, <br />rules and regulations for evaluating applications for <br />Certificates of Appropriateness submitted to it and the <br />manner in which they shall be processed. <br />D. The Commission may accept the services on a permanent or <br />part-time basis technical experts and such other persons <br />as may be required to perform its duties. <br />163.07 Certain Changes Not Prohibited <br />Nothing in this Chapter shall be construed to prevent ordinary main- <br />tenance or repair of any exterior architectural feature of any property <br />which has been designated a Landmark that does not involve a change in <br />design, material, color or outer appearance thereof, nor to prevent any <br />environmental change the Division of Building or Division of Fire or <br />Department of Public Safety shall certify in writing is required by <br />the public safety because of unsafe or dangerous conditions. <br />163.08 Penalties <br />A. Any person violating the provisions of this Chapter by failing to <br />perform any act required by this Chapter or performing any act <br />which is prohibited by this Chapter shall be guilty of a minor <br />misdemeanor and upon conviction thereof shall be fined not more <br />than One Hundred Dollars ($100.00) for each offense. Every day <br />on which a violation exists shall constitute a separate violation <br />and a separate offense. <br />B. Notwithstanding the provisions of subsection (A), in the event any <br />environmental change is made in any property which has been desig- <br />nated a Landmark, in violation of the Provisons of this Chapter <br />the City of North Olmsted may institute appropriate proceedings to <br />prevent such unlawful environmental change. <br />1'63.'09 Seyerability <br />If any provision of this Chapter or the Application thereof is held <br />invalid, such invalidity shall not affect other provisions or applica- <br />tions of this Chapter which can be given effect without the invalid <br />provision or application and to this end the provisions of this Chapter <br />are hereby declared severable. <br />SECTION 2: That this ordinance shall take effect and be in force <br />from and a tamer the earliest period allowed by Iaw. <br />PASSED : ~~f <br />ATTEST: <br />+y <br />NORA T.
