~ °.~. <br /> <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 75 - ~ / <br />BY • MR GOGGIN <br />AN ORDINANCE AMENDING ORDINANCE NO. 74-166 <br />ENTITLED, "AN ORDINANCE TO PROVIDE FOR PROPER <br />GRADING OF LAND TO PROVIDE FOR THE DRAINAGE OF <br />SURFACE WATER WITHIN THE CITY OF NORTH OLMSTED," <br />BY PROVIDING FOR THE FURTHER REGULATION AND <br />INSPECTION OF THE INSTALLATION OF PRIVATE STO~NJ. <br />WATER DRAINAGE SY3TEM5~ AS AMENDED. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION l: Definitions. That, for the purpose of this ordinance, <br />the following terms, phrases, words, and their derivatives shall have <br />the meaning given in this section: <br />a. "Natural Grade" is the elevation of the undisturbed surface <br />of the ground before the start of construction. <br />b. "Finished Grade" is the new final elevation of the ground <br />surface. <br />c. "Established Grade" is the finished, grade as shown on an <br />improvement plan or grading plan approved. by the City Engineer. <br />d. "City Engineer" wherever used shall mean the Engineer employed <br />by the City of North Olmsted and under the supervision of the <br />Director of Public Service. <br />SECTION 2: Developer's Duty to Grade within Subdivision. <br />The Developer shall submit to the City, at the same time as presenting <br />the improvement plans, a grading plan of the area to be developed. The <br />Developer shall do the grading in accordance with the plans approved.. <br />by the City and shall not deviate from that plan except upon the written <br />permission from the City Engineer, after the City Engineer has obtained <br />approval of the changes from the Council of the City of North Olmsted.. <br />Upon completion of the work, and. with approval of the Engineer for all <br />changes, the Developer will furnish the City with "As-Built" plans of <br />the improvement. <br />SECTION 3: Builder's Duty to Grade within Subdivision. <br />Building permits will not be issued for an individual building or to <br />individual builders until the builder has deposited. $500.00 for each <br />lot. In the event that a builder has more than five (5) buildings <br />in any one (1) subdivision, the City Engineer may, at his discretion, <br />reduce the amount to be deposited, for each additional building in <br />excess of five (5). <br />a. That this deposit shall be used for the establishing of <br />finished ground grades, the checking of all grades to <br />see if they conform to the approved plans, and if necessary, <br />
