<br />The Council appointed Eleanor a~.uple, Deputy Clerk of Council due to
<br />the absence from the City of E. I~1. Christman, Clerk.
<br />This meeting was called for file purpose of passing legislation to
<br />provide additional terms of compensation for special counsel to represent
<br />the City in the matter of the <~.ppeal perfected by other rlunicipalities
<br />of Cuyahoga County in the allocation. of funds from ~tYte Local Governnnent
<br />Fund.
<br />A communication was read from ~3aker, Hostetler & Patterson stating the
<br />terms of employment under which they would continue to .render professional
<br />service in the actual hearing before the Board of 1'ax .Appeals commer_cing
<br />December 3, 1959, briefin;~- the case, and for services until the completion
<br />of the matter before the Poard. of Tax Appeals up to taut not i.nclu.din~-; the
<br />possi~le takin~.r of an appeal to she Supreme Court of Ohio.
<br />Discussion ensued relat:i.ve to the interpretation n:- '?esolu ion rho. 2931,
<br />by ~;aker, 't-Iostetler ~c Patterson and it was decided it would k~e too late
<br />to hire new counsel and to continue with '?aker, Hostetler <`; .Patterson
<br />under their terms.
<br />resolution Ido. 2951 was introduced by ~Tr. Hixson. A .resolution
<br />providing additional terms of compensation for special counsel,
<br />desi;nated to k~e the law Firm o:' Balser, -Iostetler Yr. Patterson, to
<br />represent the City in the matter of the appeal perfected by of},er
<br />municipalities of Cuyahoga. County in the allocation of funds from the
<br />Local Government ~-`und to the C:i_~t~~ of i:Iorth Olmsted, and declaring
<br />an emergency. It was moved b % °~Ir. Hixson, seconded by ~~r. O'T~1ei11
<br />that the statutor;T r^,41e be sus?ended and the resolution be r°ead
<br />immediately the second and third times and put on its :~assa„e the
<br />affirmative vote on said notion was as 'ollows: tiinkel, '_ixson,

<br />the second and third times and put upon its passage and the affirmative
