<br />Mr, Rurt Richards, 5176 West Park Drive, again addressed Council, this time
<br />regarding his intent to construct a tool shed at the back of his property.
<br />He was refused a building permit, and last week appeared before the Board of
<br />Zoriing Appeals, Sec. 1133<14 of the Zoning Ordinance provides for the Board
<br />to issue rulings and then for review by Gouncil, Mr, Richards asked Council
<br />to either take no action at ali, in which case in thirty days the ruling
<br />would become final, or to take some action to allow the construction of the
<br />tool shed.
<br />Mr. Kitchen asked whether Mr. Richards came before the Board of Zoning Appeals
<br />asking for a ruling on a section of the code, or if he came before the Board
<br />asking for a special permit, then Council can hear it. If he is appealing
<br />a ruling of the Board, then Council cannot hear it. He then ruled that Council
<br />could not act,
<br />Ordinance No. 64-266 was introduced by Mr. West, An Ordinance to transfer
<br />appropriations and to make addztional approprfations for current expenses and
<br />other expenditures for the City of Narth Olmsted, Ohio, during the fiscal year
<br />ending December 31, 1964, and declaring an emergency. Mr. West moved that
<br />the rule requiring three separate readings of the ordinance be suspended.
<br />Motion was seconded by Mr. Limpert. Affirmative vote thereon was as follows:
<br />Fo1tz, Hodgins, Leonard, Limpert, Mangani, West, Mr, West then moved for sus-
<br />pension of the rule requiring reading of the ordinance in its entirety. Mr.
<br />Zimpert seconded, and the affirmative vote was Foltz, Hodgins, Leonard, Limpert,
<br />Mangani, West, Mr. West then moved for adoption of the ordinance, seconded by
<br />Mr. Limpert. Affirmative vote was Foltz, Hodgins, Leonard, Limpert, Mangani,
<br />West,
<br />Ordinance No. 64-267 was introduced by Mr. Leonard, To Levy special assessments
<br />for the construction of sidewalks in certain streets where not constructed by
<br />property owners, Mro Leonard moved for suspension of the rule requiring three
<br />separate readings of the ordinance, seconded by Mr, Limpert. Affirmative vote
<br />was Foltz, Hodgins, Leonard, Limpert, Mangani, West. Mr. Leonard then moved
<br />for suspension of the rule requiring reading of the ordinance in its entirety,
<br />seconded by Mr, Limpert, Affirmative vote thereon was Foltz, Hodgins, Leonard,
<br />?impert, Mangani, West. Mr, Leonard then moved for adoption of the ordinance,
<br />seconded by Mr. Limpert, Affirmative vote thereon was Foltz, Hodgins, Leonard,
<br />Limpert, Mangani, West.

<br />special assessments for improving North Park Drive between certain termini
<br />by constructing a water main, Mr, Leonard moved for suspension of the rule
<br />requiring three separate readings of the ordinance, seconded by Mr. West,
<br />Affirmative vote was Foltz, Hodgins, Leonard, Limpert, Mangani, West. Mr.
<br />Leonard then moved for suspension of the rule requiring the reading of the
<br />ordinance in its entirety, seconded by Mr, West. Affirmative vote thereon
<br />was Foltz, Hodgins, Le.anard, Limpert, Mangani, West. Mr. Leonard then moved
<br />for adoption of the ordinance, seconded by Mr. West, Affirmative vote thereon
<br />was Foltz, Hodgins, Leonard, Limpert, Mangani, West.
<br />Resolution No.64-269 was introduced by Mr. West. A Resolution confirming the
<br />report of the Equalizing Board on objections to tentative assessments for con-
<br />structing sanitary sewers designated in Resolution No. 61-4 as amended.
<br />Mr. West moved for suspension of the rule requiring three separate readings
<br />of the resolution. Motion was seconded by Mr, Foltz. Affirmative vote was
