? <br />k <br />MINUTES OF PUBLIC HEARING OF THE COUNCIL <br />THE CITY OF NORTA OLMSTED <br />October 12, 1970 <br />8•15 p.m. <br />Present: Councilmen Boehmer, Hodgins, Speedling, West. <br />Also present: Service Director Henry Caster, Asst. City Engineer David Ransbury, <br />Clerk of Council Nora Hill. <br />Mr. West called meeting to order with roll call. <br />The Clerk resd title of Ordinance No. 70-127 and Mr. West read the Ordinance in <br />its entirety. He then requested Mr. Ransbury to indicate on maps exact Iocation <br />which ordinance describes. Detailed description and location was outlined by Mr. <br />Ransbury on two maps. <br />Mr. West asked for comments from the audience. <br />Mr. Frank Muzika, 5133 Whitethorn Ave., said he understands that there are two lots <br />on back of Whitethorn - about half is multiple use. There is supposed to be a 50ft. <br />buffer strip between the apartments in back of him which is to run all the way <br />through. What has happened to that? Also, would this not be spot zoning. He <br />further discussed the origiaal buffer strip proposalj stating at the time Air. Biskind <br />said it would always be there. Also comwnted when the ex3sting apartments were <br />built, the driveway for same encroached on this buffer strip. Council took matter <br />to court but the ruling was inasmuch as the drivewsy was already in, same would be <br />all right, but the rest of buffer was to remain. He also aeked if the ordinance calls <br />for a 50 ft. buffer strip on multiple use or mixed use. Also, what is going to be <br />built? He further commented Mr. Caster was on Council at the time the original buffer <br />strip went in. <br />Mr. Ransbury showed the 50 ft. buffer strip on map, stating that same merely is moved <br />over. Mr. West stated there is still a 50 ft. buffer strip between the residential <br />area and the apartments. The strip need not necessarily be straight. Further, we <br />are talking about a rezoning - a rearrangement of the buffer strip frcrm the standpoint <br />that it takes a turn but it is still there. Also, the previous zoning was mixed use <br />and on this would require a buffer strip. We are naw changing the zaning €rom mixed <br />use to multiple dwelling and are requiring a 50 ft. buffer strip and same is shawn. <br />Further, the proposal is for garden type apartments. <br />Discussion continued by Mr. and Mrs. Muzika concerning original buffer strip - same <br />dating back to 1962. <br />Mr. Caster stated that as he interprets proposed rezoning, the buffer strip is still <br />there; same is just rearranged. Also, the buffer strip did not come down to Rennedy <br />Ridge. <br />Mr. Boehmer commented that there should be records in Engineering Department that can <br />be checked regarding extent of original buffer strip. <br />Mr. West stated the records wi11 be laoked up and checked into. He was not on Council <br />at the time and same does not show on any drawings. Also there is going to be
