Council Minutes of 7-16-74 -4- <br />an emergency. Mr. Goggin moved for suspension of rule requiring three separate <br />resadings, seconded by Mr. West. Mr. Goggin moved for a$optioa, sec~rnded by Mr. West. <br />Affirmative vote; Gieaser, Goggi.n, Lia~ert, Beringer, West, Wilamosky. Motion <br />carried. Ord. No. 74-I09 adopted. <br />Ordinance No. 74-110 wan introdwced by Mr. Goggin. An Ordinance acceptag a <br />15 ft. easeseat to be used for possible future raadaray i~-rot oc~ lid <br />situated on Forth Park Drive in the Ctj- of ~iorth Olsstad, aed declaring an <br />emergency. No. 74-110 adopted. <br />President Pro Tem Giessen referred Ordinance No. 74-111 to Mr. Wilamtasky, <br />Chairman Intra Governstssttal i~slatioas b Legislation Committee; and then to be <br />referred to Safety Committee. <br />Ordinance Na. 74-112 was read. An Ord~tance regtdating the placing or depositing <br />of litter, garbage, rubbish, ~utnk, autasrabiles, amd like iteets in the City of <br />North Olmsted. President Fro T~ Giessen stated since there hats been no clisc~sion <br />of Ord. No. 74-112 in Coam~attee - he is referring. Ord. No. 94-112 to fir. i~Tilaamae'ky, <br />Chairman Intra Governmw~ratal Relations & Legislation Coman~ittee. Clerk asked if <br />reading of title of Ord. No. 74-112 is considered first reading and referred to <br />Commrttee. President Pro Tenn G~ser stated. it is not a first reading. Mrs• <br />Beringer ss1~d if it would be possible to introduce it ~aecause she feels it <br />imperative that action be takaan and if it has a first reading tonight, by the <br />time Council resumes the legislatas- will be on sewed reading. President Pro <br />Tem Giessen stated according to gales of Cecil it should be referred to <br />Committee prior to introduction. for Christmac- commented the rules could be <br />suspended -this is a piece of legislation that is questionaable tahether or not <br />it was deleted from the General t?ffenarss Code. Tt is questiosaable whether the <br />General Offenses Code that was adapted effective January 1, 1974 deleted this <br />legislation. Feels if tyre ins any question at all -this should be passed and <br />get same in effect. Lear' Director Gareau stated aeffective January 1, 1974, the <br />State of Ohio enacted a near Cr#a~3nal Code m+hieh moray municipalities felt sad he <br />believes also that affected the t~eaeral Offenses Code so, conseque~ttlg, the City <br />of North Opted do December 1l~, 1973, repealed the then euisting GsDeral Offenses <br />Code and adopted a model General Offenses Code. There is aom~e language in the <br />ordinance adopting the Nodel that, as far as Law Director Gareau 3a conc~arasad <br />would cast doubt on to ~rether or not this part~:cular section was kept or whether <br />it was repealed; thinks it would be an inadequate defense if anybody were prose- <br />cuted under this Section. Coa~aadquently, the Building Department has had a great <br />deal of difficulty working around this problem, so we are looking for soave Way <br />to cite people. that are violating this particular section of the Code. It is <br />Mr. Wilatcaosky's recomosadsticn that not only this particular piece of ]regislati©n <br />be re-enacted but there is ~ addition thereto in Section C. Mr. Wilam~tky <br />stated we have discussed in tl~e past the semi-trailer parking violation within <br />the coetmunity and in discussing this with the Building Co~aisai+~r ~d ttion of <br />Director, the legislation is basically the same ae was repealed ua ada~p <br />the General Offenses Cods with the addition of Section C which includes semi- <br />tractor trailers. <br />;~~n~~« <br />
