. ? ,._ <br />Council Minutea of 11/15/83 <br />-6- <br />Under Old Business (cont'd): <br />Law Director Gareau pointed out that if this is Council's position, the motion is <br />superfluous because all Council has to do is call this to the attention of the <br />building official and leave the ruling to the official. He is the only one whp can <br />rule. He is the one who already ruled about the "through lot". Council has no right <br />to make a ruling relative to an interpretation of the Zoning Code. This is strietly <br />up to the Building Comnissioner. Council should convey this thought to him and if he <br />agrees, then there is no question and no arguement about this. <br />Mr. Woerpel replied that it may be superfluous, nevertheless, it is his intent, that <br />Council, as a body, neds to restate that intent; certainly the Building Commissioner <br />will be aware of the actions tak.en at the Council table and can do what he needs to do. <br />Discussion continued on this issue until President Boehmer called for the question. <br />Ro11 call on Mr. Woerpel's motion that the action taken by the Board of Zoning Appeals, <br />at their regular meeting on September 7, 1983, regarding the parcel of land located <br />at 26035 Lorain Road, is not determinative of a setback requirement because existing <br />ordinances, 1125.62 and 1174.02 require a fifty foot setback from any street line in <br />all p-roperty zoned retail and said ordinances control on this issue, seeond by <br />Mrs9 Petrigac. Affirmative vote: Bierman, Logan, McKay, Petrigac, Saringer, [ailamosky, <br />Woerpel. Motion approved unanimously. <br />Mr. Bierman asked if the Mayour had made any efforts toward keeping the State Liquor <br />Store in North Olmsted. Mayor replied that an attempt was made to put it 3n the old <br />Taco Villa area but there was ,just not enough time to do it. They may remain in the <br />area if they find a place to move into. <br />Mr. McKay asked the Mayor what the status was with resnect to the left turn signal on <br />Clague Road. Mayor Swietyniowski replied he has iaet with the County and addressed <br />the upcoming plans for the whole intersection at Clague and Lorain Roads; will probably <br />go out for bids next Spring; plans include turn lanes on both sides of the road, in- <br />cluding widening the intersection; plans are on file in his office for Council's <br />perusal. <br />Mr. McKay asked i£ all Service Department personnel was busy with the leaf pickup; <br />Mr. Corrigan replied that duties fluctuate. Today, due to absentees, every man in <br />the Service Department is on the leaf pickup exclusively. No other activities whatso-• <br />ever; tomorrow there may be sign problems to handle. Is attempting to concentrate on <br />the leaves bef_ore the arrival of more inclement weather. Will be able to work in the <br />slag for street repair before ?ainter really hardens in. <br />Mr. ?ailamosky discussed the recently completed resurfacing of Lorain Road; many low <br />spots are holding a considerable amount of water; feels the State should be made <br />aware of the problem. Service Director advised they have a2ready notified the State. <br />Also discussed was the criteria for curb replacement. State budgeted 4,000 feet of <br />curb replacement; it had to be done on a selective laasis within the budget parameters <br />of the contract. <br />Under New Business. <br />Councilwoman Saringer xead her letter of resignation, effective immediately, and <br />after handing her xesignation to Pxesident Boefimer, left the Council table and took <br />a seat in the audience. <br />At this time, 9:35 P.M., Councilwoman Petrigac and Councilmen 3ierman and Woerpel <br />left the Council table and the Council chamlier. <br />? ;
