Council Minutes of 4/3/84 -2- <br />Law Director Gareau reported: 1) The Dinunzio Case was tried in Akron last week; <br />is presently preparing a brief in lieu of final argument; expects a decision within <br />the next two weeks. <br />2) With .respect to King's Path Condominiums, the City was ordered to assist in <br />abating a private nuisance and Law Director has appealed that decision. King's <br />Path also appealed the decision of the lower court because after instructing the <br />City to assist in abating a private nuisance, the Judge made another ruling which <br />King's Path did not like. Because they failed to file their brief and assignment <br />of error, the Court of Appeals dismissed their appeal and presently, there is only <br />one appeal pending with respect to King's Path. <br />Safety Director Petre reported: 1) Recreation Complex income figures for March, <br />1984, indicate an improvement over March, 1983; Recreation Department is presently <br />planning Summer Programs; Tce rink will be closed from July 1st until the day after <br />Labor Day. <br />2) Specifications have been completed for the chassis for Squad 51; will be <br />advertising for bids next week with. bid opening on May 1st at noon. <br />3) Specs for the three police cruisers will be completed this week; will advertise <br />for bids next week. <br />Mr. O'Grady, Chairman Public Safety, Health and Welfare Committee reported: <br />1) Committee met March 27, 1984, and reviewed Ordinance No. 84-17, false alarms and <br />malfunctioning alarm systems. Also in attendance were President Boehmer, Council- <br />man Bierman and Chief Taylor. This ordinance replaces Ordinance No. 82-159 and is <br />more comprehensive. Specifically, under Section 559.02, "Definitions", false alarms <br />include alarms that are activated to off-premise locations by certain noise levels. <br />Under Section 559.08, "Permit and Fees", commercial subscriber fees are reduced from <br />$30 to $20; private and residential fees are reduced from $10 to $5; renewal fees on <br />commercial are reduced from $15 to $10; private and residential renewals are reduced <br />from $5 to $3. The Safety Committee unanimously approves adoption of Ordinance No. <br />84-17. <br />2) Mr. O'Grady moved Council support the Polaris Vocational School Tax Levy on the <br />May 8th Primary, second by Mr. Bierman, unanimously approved. <br />3) Mr. O'Grady moved Council support the School Levy for the City of North Olmsted, <br />second by Mrs. Petrigac, unanimously approved. <br />Mrs. Petrigac, Chairman Recreation, Public Parks and Buildings Committee as well as <br />Transportation Committee reported: 1) Transportation Committee met on Thursday, <br />March 29th, with all members present as well as Councilman O'Grady. Mr. O'Grady had <br />arranged for Mr. Joseph T. Pesch of the Ford Motor Company to address the committee <br />with respect to leasing vehicles. The municipal lease/purchase financing is an <br />alternate source of tax exempt financing which can be used as an alternate source of <br />funds to acquire necessary equipment. The interest portion of the payment is exempt <br />from Federal Tncome Tax and the transaction is considered a current obligation of the <br />leasee although the agreement may cover many years. City would have the option to <br />purchase at the end of the agreement for $1.00. Lease term is determined by the <br />normal life of the equipment. Equipment can be obtained without large appropriations <br />of funds from the budget. Interest rates at this time are approximately 8%/9%. <br />Committee suggests the Administration take a serious look at the possibility of <br />leasing automobiles. <br />2) Landmarks Commission held a special meeting on Saturday, March 30th to discuss <br />asking Council to reconsider its vote on Ordinance No. 83-96.
