Council Minutes of 11/17/87 _2_ <br />6) Saturday evening, attended a dinner prepared by VFW Post 7647 to recognize <br />the Policeman and Fireman of the Year; award this year went to Lt. Ray Bement, Jr. <br />of the Fire Department and Officer Charles Jandecka of the Police Department. <br />7) On October 27th, Budget and Management Director presented his financial figures <br />to Council. Council was requested to put any disagreement with those figures into <br />writing. Since the meeting was held almost four weeks ago and there has been no <br />communications from any Member of Council, or the Finance Director, disputing the <br />figures as presented, the administration assumes that all agree the figures are <br />correct. <br />8) Mary Biemel, the Outreach Worker at the Senior Center is in St. John's hospital; <br />Norma Lingruen, Chief Marsh's secretary, has also been in the hospital and is now <br />at home recuperating. <br />9) Christmas lights will be going up, utilizing some of the city employees; if <br />Council has any objections, please advise. Any Christmas ornaments or decorations <br />would be appreciated. <br />10) Department of Human Resources is currently collecting canned goods and money <br />donations for the Thanksgiving baskets. <br />11) The administration has requested State Representative Petro and Senator <br />Suhadolnik to make sure that North Olmsted/Cuyahoga County be allotted its <br />appropriate share from the approval that came from Issue 2 to permit the State <br />of Ohio to sell obligation bonds to aid in public works projects. <br />12) Appointments to commissions for 1988 will be made; anyone interested in serving <br />is requested to submit a resume. A Democrat must be appointed to the Civil Service <br />Commission; would appreciate receiving applications for this position. <br />13) Income tax for October came in at approximately $76,978 lower than what was <br />collected in October, 1986; city is therefore receiving about $25,000 less than <br />last year just in income taxes. <br />Law Director Gareau reported: 1) A law suit was filed against the city dealing <br />with an allegation that the city improperly inspected a f fireplace which was in- <br />stalled about 15 years ago. Although the Law Department was involved in the <br />negotiations, the insurance compnay also became involved and contrary to the <br />Law Director's advice, settled the case for $500. Law Department advised against <br />payment since the city has governmental immunity. Although the settlement did <br />get the city out of litigation and stopped the insurance company's attorney fees <br />from mounting, it was still something the Law Department did not recommend. <br />The costs for defending the suit have to be paid by the city and there was also <br />a deductible; currently is in dispute with the insurance company in this matter. <br />2) Over the last three weeks, has been working on the brief to be submitted in <br />the Sixth Circuit for the Cooper Case; in the past week submitted a reply brief <br />in the Slifka Case. <br />Finance Director Boyle reported: 1) In 1960, City of North Olmsted borrowed <br />money on a revenue issue to build the Wastewater Treatment Plant and agreed to <br />make quarterly payments to the Ohio Citizens Bank of Toledo which would go into <br />three different accounts: a receiving account, an account to pay and redeem <br />principal and interest, a third account for investment. Finance Department also <br />established a fund, in house, to further secure the principal payment - this is <br />the Sewer Escrow Fund. Currently, city has approximately $300,000 in Toledo, <br />invested, for payments against MR - this is the MR1 bond - and have $88,000 on <br />hand in the Sewer Escrow Fund. Obligation this year to principal and interest <br />was $96,300 and so far have paid $48,110. Finance Director has made, arrangements <br />with Ohio Citizens Bank to make a payment of $24,854 from the Sewer Escrow Fund, <br />to be applied against the redemptions of December 1st. They will take the re- <br />mainder, $23,336, out of the funds on deposit with them; this will clear up <br />$43,190 in the Sewer Revenue Fund which is the fund that operates the Treatment <br />Plant. Finance Director is doing it this way because there is a "call" provision <br />involved in this bond. Up until December 31, 1987, city can call principal and <br /> <br />
