~. <br />Special Council Minutes of 8/11/88 -3- <br />Mr. Bohlmann stated that for all intents and purposes, he feels it is the same <br />thing - it is a commercial use of residential property and even though they do <br />not embalm, whether you call it a "chapel" or a "viewing room", it is a <br />commercial enterprise to make a profit. Mr. Gareau responded that commercial <br />enterprises for profit are not excluded from residents district. The question <br />was "is having a chapel in a cemetery a permitted use" and the board said it was. <br />Mr. Bohlmann stated that he felt that the term "permitted use" was being <br />stretched to some degree by this ruling. <br />President Saringer stated that her concern was that embalming was going to be <br />done in this proposed. building. Law Director responded that the Sunset <br />Memorial representatives, at the BZA hearing, stated that this was not, in <br />fact, true. If such an activity did take place, then that would be inconsistent <br />with the board's ruling and would be subject to an injunction to stop such a <br />practise. <br />Mr. McKay moved to overturn the approval of the Board of Zoning Appeals in the <br />matter of the Sunset Memorial Park's use of a viewing room, second by Mr. Boehmer. <br />Roll call on motion: Affirmative vote: Boehmer, Bohlmann, McKay, Tallon. <br />Negative vote: O'Grady, Wilamosky. 4 Aye - 2 Nay - Motion carried. <br />Mr. McKay moved to excuse the absence of Councilwoman Bahas, second by Mr. Bohlmann, <br />unanimously approved. <br />The agenda being completed and there being no further business, President Saringer <br />adjourned the Special Council Meeting at 8;15 P.M. <br />lorence E.
