ALisENZE <br />PrwaeutinQ Attorney <br />777-51100 <br />Please be advised that as Chief Legal Officer for the City of North <br />Olmsted, I have had an opportunity to review the resolution which was <br />submitted to City Council in the form of a motion at the council meeting of <br />September 19, 1989, dealing with the above permit premises. <br />I have had an opportunity to review the complaints that have been responded <br />to by our police department officials, and believe that the types of <br />complaints in both 1988 and the first nine months of 1989 constitute valid <br />legal grounds for objecting for the renewal of the above license. More <br />particularly, I believe that the permit holder has, after notice, blatently <br />disregarded local laws and regulations dealing with noise control and <br />disorderly conduct. It should be further noted that because of the <br />location of this establishment, in relation to the residential <br />neighborhood, the activity of the permit holder has drastically affected <br />the decency, sobriety, peace and good order of the neighborhood. <br />I trust that this opinion sufficiently satisfies your requirements.
