MINUTES OF THE MEETING OF THE COUNCIL <br />OF THE CITY OF NORTH OLMSTED <br />JUNE 19, 1990 <br />Present: President James Boehmer, Council Members Bahas, Leonard, McKay, <br />Nashar, O'Grady, Saringer, Tallon. <br />Also present: Mayor Edward Boyle, Law Director Michael Gareau, Finance <br />Director James Burns, Acting Clerk Kim Vanover. <br />Meeting was called to order by President Boehmer at 8:00 P.M., in Council <br />Chambers, 5200 Dover Center Road, North Olmsted, Ohio. <br />President Boehmer invited members of the audience to join Members of Council in <br />reciting the Pledge of Allegiance to the Flag. <br />President Boehmer announced: 1) Ordinance Nos. 90-82, 90-83, 90-84, 90-85 and <br />90-86 have been added to tonight's agenda. <br />2) Suspension of rule requiring three readings will be requested on the above <br />enumerated ordinances. <br />Mayor Boyle reported: 1) Presented a proclamation to Dolores J. Dungan, <br />recipient of the Battelle Award for Professional Development, and commended <br />and congratulated Ms. Dungan for her dedication to education and her achieve- <br />ments as an excellent mathematics. teacher. <br />2) Has received, from the Ohio Environmental Protection Agency, a revised draft <br />project priority list for construction grants and water pollution control loan <br />fund programs. Copies have been distributed. <br />3) Last week, committee discussed Ordinance No. 90-66 which addresses visual <br />obstructions which were causing safety hazards. The committee questioned if <br />there should be a "grandfather clause" added because it could involve signs, <br />bushes, etc. Has discussed this legislation with Building Commissioner Conway <br />and his opinion is that there should not be a "grandfather clause" included in <br />the enforcement of this ordinance since the city is dealing with a safety item. <br />If this legislation is passed, it will allow the Police Department to enforce <br />the law when the Building Inspectors are not available. <br />4) Discussed airport noise with Mark Cortney at Hopkins Airport and have been <br />advised that they are approximatley ten days away from a solution to this <br />problem. Has also received a letter from Steve Nagy at Hopkins which states <br />that he is reissuing the noise abatement procedure to all aircraft using <br />Hopkins during the summer. <br />5) With respect to income tax funding, at the first meeting, it was agreed to <br />"ear-mark" funds for street drainage programs, permanent improvements and <br />solid waste management, which is a legal way of saying "recycling". Squire, <br />Sanders and Dempsey have amended copies of the legislation covering this, <br />and have changed the wording to make it more understandable to the general <br />public. <br />Law Director Gareau reported: 1) With respect to Ordinance No. 90-66 which <br />covers visual obstructions, someone should have asked the Law Director whether <br />t or not it was appropriate to consider a "grandfather clause". Probably more <br />appropriate whould have been to ask if the city could enforce a "grandfather <br />clause" or whether or not you have to have one. In his opinion, it is not <br />a zoning code and that is where the concept of a "grandfather clause" comes in. <br />It should be thought of as noise control; can anyone be "grandfathered" in on <br />noise control? The answer is no because it is a regulation. <br /> <br />
