MINUTES OF THE MEETING OF THE COUNCIL <br />OF THE CITY OF NORTH OLMSTED <br />MAY 15, 1990 <br />Present: President James Boehmer, Council Members Bahas, Leonard, <br />McKay, Nashar, O'Grady, Saringer, Tallon. <br />Also present: Mayor Edward Boyle, Law Director Michael Gareau, Finance <br />Director James Burns. <br />Meeting was called to order by President Boehmer at 8:00 P.M., in Council <br />Chambers, 5200 Dover Center Road, North Olmsted, Ohio. <br />Members of the audience were invited to join Members of Council in reciting <br />the Pledge of Allegiance to the Flag led by Members of the Boy Scouts and <br />Girl Scouts of America. <br />President Boehmer introduced Mr. Dillon who spoke on behalf of the scouts; <br />introduced the Chairmen, Mr. Paul Black and Ms. Karen Novak, of All Scouts' <br />Day which will be held on June 1st, 2nd and 3rd; mock Council Meeting will <br />be held on June 2nd in council chambers. <br />Councilwoman Bahas waved to appoint Finance Director Burns as temporary <br />Clerk of Council during Clerk Campbell's absence, as stated in Article 5, <br />Section III of the Charter, second by Mrs. Saringer, unanimously approved. <br />President Boehmer reported: 1) Ordinance Nos. 90-65, 90-66, 90-67, 90-68 <br />and 90-69 will be added to tonight's agenda. <br />2) Suspension of rule requiring three readings will be requested on Ordin- <br />ance Nos. 90-68 and 90-69. <br />Mayor Boyle reported: 1) Will announce the name of the new City Engineer <br />at the next meeting of council. <br />2) With respect to the Deerfield area, all studies have been completed and <br />show an enormous amount of infiltration going through the laterals which <br />cause many problems at the Wastewater Treatment Plant. Will be contracting <br />out to seal these laterals through legislation to be presented at the next <br />council meeting, using Step III monies. <br />3) Was in Washington last week attending a conference sponsored by Congressman <br />Edward Feighan. Conference concerned various city problems and solutions. <br />4) Discussed in caucus this evening, the suspension of two commissioners on <br />the Civil Service Commission as per Article 6, Section VI of the City Charter; <br />this must go to council and be ratified. Councilwoman Bahas, Chairman of the <br />Legislative Committee, will be scheduling a meeting to discuss this issue <br />and to invite the two commissioners to be in attendance if they so desire. <br />Law Director Gareau reported: 1) With respect to the arbitration regarding <br />an alleged defect on David Drive which caused an injury to Shamus Conlan, <br />an award of $8,000 was made. Although the Law Director believes this sum to <br />be too high, does not recommend appealing the decision; the amount will be <br />paid out of the Casualty Loss Fund. <br />2) Today, attended a hearing in the Court of Appeals with respect to Smith <br />versus City of North Olmsted; this has to do with a claim by Dick Smith of <br />the North Olmsted Fire Department for vacation time when he was in the <br />National Guard. Has received briefing schedules from both sides and intends <br />to file motions for summary judgments. <br />4 <br />
