MINUTES OF TIC PUBLIC HEARING <br />MAY 21, 1991 <br />7 P.M. <br />Present: President Pro Tem Nashar, Council Members Leonard, McKay, <br />Saringer, Tallon. <br />Also Present: Clerk of Council Barbara Seman. <br />President Pro Tem Nashar called the Public Hearing to order at 7:05 p.m. <br />President Pro Tem Nashar announced that Ordinance No. 90-125 would be on <br />for public hearing. An ordinance adopting a new and revised Pla~ming <br />and Zoninro Code for the City of North Olmsted. <br />There was no audience participation. <br />Mrs. Saringer mentioned that a few items would have to be added to the <br />Code. The following additions had been discussed at the BZD meetings: <br />1. Upon the suggestion of Mr. Cornaay and Mr. Gareau, add to Section <br />1135.08 a new number 5 under subsection B on page 24 of the proposed <br />Zoning Code. This is in regard to Rear Yard Requirements and <br />stairwells. The paragraph shall read: "Where stairwell for access to <br />below grade portions of a dwelling has been legally constructed prior to <br />the adoption of this code, the installation of an enclosure or covering <br />of this stairwell shall be excluded. when computing rear yard depths." <br />This will be beneficial to the residents as well as not requiring these <br />matters to be reviewed individually by the Zoning Board of Appeals. <br />2. Mr. Conway reviewed the changes and came across two paragraphs in <br />Chapter 1149 that caused him concern. The following changes will be <br />made: <br />a. Section 1149.03, Faragraph C--the first sentence will be altered by <br />eliminating the words, "mixed use district A" and inserting "Sections <br />1135.01 A & B." <br />b. Section 1149.03, Paragraph E--will now read, "Any land within the <br />City of North Olmsted zoned 'mixed use district A' before the adoption <br />of this Zoning Code shall remain designated 'mixed use district A'. <br />Further, any land zoned 'mi.xed use district B' prior to the adoption of <br />this zoning code, shall be hereinafter designated 'mixed use district <br />C. t ~~ <br />It was decided that in the motion to adopt the ordinance, it would be <br />noted that these changes would be included as part of the Zoning Code. <br />E <br />President Pro Tem Nashar adjourned the Public Hearing at 7:10 p.m. <br />
