MINUTES OF TIC PUBLIC HEARING MAY 21, 1991 7 P.M. Present: President Pro Tem Nashar, Council Members Leonard, McKay, Saringer, Tallon. Also Present: Clerk of Council Barbara Seman. President Pro Tem Nashar called the Public Hearing to order at 7:05 p.m. President Pro Tem Nashar announced that Ordinance No. 90-125 would be on for public hearing. An ordinance adopting a new and revised Pla~ming and Zoninro Code for the City of North Olmsted. There was no audience participation. Mrs. Saringer mentioned that a few items would have to be added to the Code. The following additions had been discussed at the BZD meetings: 1. Upon the suggestion of Mr. Cornaay and Mr. Gareau, add to Section 1135.08 a new number 5 under subsection B on page 24 of the proposed Zoning Code. This is in regard to Rear Yard Requirements and stairwells. The paragraph shall read: "Where stairwell for access to below grade portions of a dwelling has been legally constructed prior to the adoption of this code, the installation of an enclosure or covering of this stairwell shall be excluded. when computing rear yard depths." This will be beneficial to the residents as well as not requiring these matters to be reviewed individually by the Zoning Board of Appeals. 2. Mr. Conway reviewed the changes and came across two paragraphs in Chapter 1149 that caused him concern. The following changes will be made: a. Section 1149.03, Faragraph C--the first sentence will be altered by eliminating the words, "mixed use district A" and inserting "Sections 1135.01 A & B." b. Section 1149.03, Paragraph E--will now read, "Any land within the City of North Olmsted zoned 'mixed use district A' before the adoption of this Zoning Code shall remain designated 'mixed use district A'. Further, any land zoned 'mi.xed use district B' prior to the adoption of this zoning code, shall be hereinafter designated 'mixed use district C. t ~~ It was decided that in the motion to adopt the ordinance, it would be noted that these changes would be included as part of the Zoning Code.
