Council Minutes of 02-02-10 <br />Chapter 1363 of the Real Property Maintenance Code, entitled "Duties and <br />Responsibilities of Owners and Operators" and to adopt standards for rubbish disposal <br />and recreational vehicle covers relating to the exterior appeazance of residential buildings <br />and premises in the City of North Olmsted. Councilman Barker discussed the notion that <br />this is really relating to the brush pick-up program adopted last year by the city. <br />Previously, the city had a brush pick-up schedule where the homeowner would call and <br />indicate there was brush pick-up and it would be taken care of by the city, and that's been <br />cut back in 2009. In response to that, Councilman Barker indicated that the former <br />Service Director, Council President Limpert, had received information indicating that the <br />current Ordinances had enforcement issues relating to that as brush pick-up had been cut <br />back. What they found happening was that residents were leaving brush out on their tree <br />lawn well after the scheduled brush pick-up, and that was becoming unsightly and <br />creating issues in various neighborhoods. With that in mind, the Ordinance was crafted <br />to give the Service Department, Building Department, and Property Maintenance Code <br />more of an effective tool for enforcement in keeping tree lawns neater and cleaner. It <br />was noted by Dr. Thomas along with sponsor Bazker that the Building Department would <br />have the authority through the Ordinance, if adopted, to issue a warning letter to the <br />homeowner in regazds to the brush. pick-up Ordinance and their responsibilities there <br />under, and that if the situation wasn't corrected, a citation would be issued. Further, the <br />Ordinance discusses and addresses the proper manner in which to cover recreational <br />vehicles. Councilman Mahoney made a motion to recommend approval. The motion <br />was seconded by Councilman Kearney and passed 3-0 to recommend approval. The <br />Public Safety Committee ended its meeting at 7:53 p.m. <br />Councilman Mahoney gave a report for the Ethics Commission of the City of North <br />Olmsted: <br />The Ethics Commission met on Tuesday, January 26, 2010 at 6:30 p.m. The following <br />members were present: Council President Limpert, Councilman Barker, Councilman <br />Mahoney, Human Resources Director Farver and Finance Director Copfer. Law Director <br />Gareau was also in attendance along with guests. <br />• Councilman Barker nominated Councilman Mahoney to be Chairman. Upon a <br />unanimous vote, Councilman Mahoney was made Chairman of the North Olmsted <br />Ethics Commission. <br />• The meeting was turned over to Law Director Gareau for his comments and <br />thoughts. He opened the meeting with his commentary on an overview of <br />Chapter 107 that had been drafted by his predecessor, Mr. Dubelko. He noted <br />that a lot of work and effort must have been put into this because the multiple <br />page document kind of mirrors the current State Code as it pertains to the Ethics <br />Commission. One of the issues discussed was whether or not the city should have <br />an Ethics Commission given that there is a State of Ohio Ethics Commission that <br />covers the same type of areas. When an ethics complaint is filed with the City, <br />either side can go before the Ohio State Ethics Commission. There's apparently <br />some type of redundant work that would be involved.
