Council Minutes of 10-04-2011 Ordinance 2011-96 fails 3 - 4. Regarding Councilman Mahoney's comments, Gareau thanked him for his expression of confidence. He assured Mahoney that should the Mayor and his authority under the Ohio Revised Code direct him to fulfill those obligations, he shall do so to the best of his ability. It's not above and beyond the duties of the Law Dept. Both positions of Law Director and Asst Law Director were reduced to part-time from full-time at the beginning of 2010. Ordinance 2011-74 introduced by Mayor Kennedy was given its second reading. An Ordinance amending Section 915.04 of the Codified Ordinances of the City of North Olmsted to establish revised charges for the use of the municipal sanitary sewer system; repealing existing Section 915.04 of the Codified Ordinances; and declaring an emergency. Ordinance 2011-100 introduced by Mayor Kennedy on behalf of himself and the entire City Council was given its second reading. An Ordinance to revise the Codified Ordinances by adopting current replacement pages, and declaring an emergency. Councilman Barker made a motion to suspend the rule requiring three readings. Ordinance 2011-100 adopted. Resolution 2011-102 introduced by Mayor Kennedy was given its second reading. A Resolution authorizing the Director of Planning & Development to advertise for bids for the award of a contract to provide construction services for the North Olmsted Facilities Energy Conservation Project, as detailed in the specifications on file in the Building Department, and authorizing the Mayor, following approval of the Board of Control, to contract for the same with the lowest and best bidder, and declaring an emergency. Councilman Barker made a motion to suspend the rules requiring three readings. The motion was seconded by Councilman Kearney and passed unanimously. Councilman Barker moved for adoption. An Ordinance to make and transfer appropriations for current expenses and other expenditures for the City of North Olmsted for the year ending December 31, 2011, and declaring an emergency, as amended. Councilman Barker made a motion to suspend the rule requiring three readings. The motion was seconded by Councilman Schumann and passed unanimously. Councilman Barker moved for adoption. A Resolution authorizing the Mayor to enter into an agreement with Riverside Drives, Inc. to provide for equipment and installation services to upgrade the Broxbourne Lift Station at a final cost not to exceed $24,893.00, and declaring an emergency. Councilman Barker make a motion to suspend the rules requiring three readings and formal committee review. The motion was seconded by Councilman Kearney and passed unanimously. 9
